A Democratic member of the Senate Judiciary Committee said Sunday he believes Samuel Alito will get an up-or-down vote on his Supreme Court bid.
"We should commit," said Sen. Joseph Biden (news, bio, voting record), D-Del., minimizing prospects of a Senate filibuster that would prevent final action on President Bush's choice to replace retiring Justice Sandra Day O'Connor.
"I think the probability is that will happen," Biden said on ABC's "This Week."

I don't think you'll be disappointed. That fat fool can't help himself; he'll be just as stupid as anyone could want, and Alito, like Roberts, will be picking his teeth with the fat fool's bones when it's all over.

the dems know they will lose the fight, and since it looks like they will lose a filibuster fight too, it's just not worth it to them.
too bad for us. the fight would have done this country a world of good. maybe we'll get another chance?

I would love a fight, but I think the folks in D.C. have finally figured out a fight on the Judiciary lopsided benefits Conservatives, by default Republicans.
What Biden is really saying is that the red state Dems & RINO's don't want to face our wrath in an election year, and have given a red light at talk of a filibuster. This is Biden acknowledging he doesn't have any way to stop it.
Still, never trust a RINO or a DEM. Until confirmed, keep an eye on them.

I don't see him doing that while Bush is in office, barring a medical emergency. But an Anthony Kennedy retirement is a possibility.

There is a rumor over at Confirmthem.com that Souter wants out as soon as he can get his retirement which is sometime in 2006 or 2007. I don't think I believe it but I thought I'd put it out there as another happy thought.

It is too bad. It's too bad we didn't really give them something to fight about, like Janice Rogers Brown. Talk about giving them the hives. They wouldn't have known what to do, because on the one hand they would have lost the fight, but on the other, if they failed to put up a fight they would have been forced to concede their whole judicial ideology.
Like you say, maybe next time.

They really don't want to set the precedence. They'd get it shoved down their throats if they regained the Whitehouse. It was used as a delay tactice but that time has ended and the people are getting Pi**ed. Besides, they don't want this to take away from their "Get Rod of Rove" plan.

Now if John Paul Stevens, who is 85, would retire. I strongly suspect that the only way Bush will get another Supreme Court pick is if one of the remaining Justices retire in the same manner as Rehnquist. There is no chance that Stevens or Ginsburg (the two oldest and furthest to the left) will leave feet first during a Republican administration.
