A federal appeals court on Wednesday dismissed a lawsuit by elementary school parents who were outraged that the Palmdale School District had surveyed students about sex.
While the surveys asked students how often they thought about sex, among other questions, the 9th U.S. Circuit Court of Appeals said parents of public school children have no "fundamental right" to be the exclusive provider of sexual information to their children. The parents maintained they had the sole right "to control the upbringing of their children by introducing them to matters of and relating to sex."
The plaintiffs had sought unspecified monetary damages.
In upholding a lower court that had also ruled against the parents, a three-judge panel of the appeals court here dismissed the case, ruling unanimously that "parents are possessed of no constitutional right to prevent the public schools from providing information on that subject to their students in any forum or manner they select."

Seems to abridge the parents right to practice religious beliefs e.g. teach thier precepts of morality to their children -exclusivity is supposedly guaranteed by the constitution... The state sponsored secular humanistic religion takes precedence over the parents religion...

Odd to see a thread full of conservatives blasting the 9th Circuit for refusing to engage in judicial activism. Did anyone notice that the lawsuit demanded that the court create a new right out of thin air?

I really think we need to curb the purview of the courts. By a huge margin.
So liberals think government should stay out of our bedroom only if we're adults.

[Unless there's something I don't know] At the same time, you pay for public schools. That is wrong. Not all parents think that they can juggle home schooling with their tax burden. You are paying for a piper you don't even listen to.

That's true. I don't have a problem with creating choice in the area currently occupied by the public school monopoly. However, at the current time, if you want to send your kids to public school, you'll have to accept the rules that the education establishment imposes on you.

LOL, Massachusetts is even worse, if that's possible. In Massachusetts they teach "fisting" in the elementary schools. The teachers and their union have a real fun time in Massachusetts.
I guess with some of the homosexual cases I can maybe see that. I don't know. I can't imagine anything like that here though, certainly not in my school, but definitely NEVER in my class. They might teach fisting at the local boxing club though.
I say let the PARENT DECIDE. And I don't think much of someone who wants to cram stuff down a kid's throat when the child's parent disagrees. Let the parent be the boss. School choice clears up most of this. The public school system is a cesspool, and everyone knows it. It's a disaster in EVERY respect.
"Men in Black" ? Sounds good to me. The 9th Circuis deserves it.
In high school, we had a few about drinking and drugs. They were no big deal. Sometimes I put down funny answers, sometimes I didn't. I didn't worry too much about it since I never touched the stuff anyways.

I don't believe that students can be "struggling with homosexuality." Yes, some may exhibit those tendencies, but those decisions should be made as an ADULT.
It doesn't belong in ANY school.
