You're asking Bush to be a robot. He's a human being, and human beings can do some strange things when they've been humiliated. Bush will not take out any ire with a new nominee. He knows he doesn't need the aggravation. But, I don't suspect he'll do much to advance them.
No, I think Bush will wait and pick another area of policy in which to differentiate himself from the fringers.
Bush is not going to allow himself to be a captive to any particular part of the GOP.
Reagan didn't do it, and Bush won't either.

I want the court to follow the laws as written and within reason, the spirit of the origin. If we do this, if we don't like a ruling then we just change the law.
That is no doubt what you will get - a moderate - but please remember that prior decisions are settled law as well - and thus, all the straying from the original intent can never be corrected without legislation.

Kristol opposes the President when he truly disagrees with him. He may well dislike the President. But Kristol is not going to use the Miers opportunity to bring down the Bush administration at the cost of the party and principles he believes in, which was the ludicrous charges made on this thread.Kristol is ambitious and would undermine the president if it would get him more facetime on FNC or a top position in a McCain administration. It's not that he doesn't have principles and an ideology -- he does -- but he cares a great deal more about his own professional success.

Retired Senators are not the elite (i.e. "non-people")? This is getting wacky...
Anyway, if you interviewed most of the "people" today, they would say that its the Supreme Court's job to decide policy questions such as abortion. Sad, but true. This is why we need somebody who can intelligently articulate the opposite position.

The terms moderate, liberal and conservative have no meaning in the judicial arena. They only apply if the person violates their obligations and bases rulings on political ideology rather than the actual law.
We have a legislative branch to write the laws and we have method to amend the constitution, why blur the lines and put the judicial branch into legislative business?
