ROBERT BORK CALLS THE HARRIET MIERS NOMINATION "A DISASTER" ON TONIGHT'S "THE SITUATION WITH TUCKER CARLSON"

SECAUCUS, NJ - October 7, 2005 - Tonight on MSNBC's "The Situation with Tucker Carlson," former judge and Supreme Court nominee Robert Bork tells Tucker Carlson the Harriet Miers' nomination is "a disaster on every level," that Miers has "no experience with constitutional law whatever" and that the nomination is a "slap in the face" to conservatives.

Following is a transcript of the conversation, which will telecast tonight at 11 p.m. (ET). A full transcript of the show will be available later tonight at www.tv.msnbc.com. "The Situation with Tucker Carlson" telecasts Monday through Friday at 11 p.m. (ET).

Bork has said he thinks the 2nd amendment is an anachronism, while Harriet Miers considers it a fundamental individual right.

And remember, Bork had both Bill and Hillary in his law classes at Yale and praised them both as exceptional. I'm leaning towards Miers, more and more.

And I'm leaning more and more to the idea that there are almost as many elitist windbags in top "conservative" circles as there are in top "liberal" circles (with the difference being, of course, that the liberal windbags also openly support all enemies of the USA).

"No, I do. But I don't think she belongs on the Supreme Court any more than Harriet Miers does."

Nothing wrong with that opinion. I am merely objecting to people who say Miers does not stand apart from any other lawyer. She clearly does.

There is always the possibility beyond the fear and hysteria that Harriet Miers will be confirmed and become the strict constructionist we desire siding closely with Justice Antonin Scalia on many issues.

There is also a possibility President Bush will still be in office to replace Justice John Paul Stevens with another strict constructionist like Janis Rogers Brown leaving the SCOTUS firmly in conservative hands for decades.

Well, I'm tired of people re-writing history about the devision over Roberts, as well as trying to spin damn poor ratings for Miers as a good thing while suggesting those in opposition are insignificant.

The FR poll ranked Roberts in the mid 80% approval range. the Meirs poll ranks her in the mid to lower 30% approval range.

That's the truth, and that can't be changed. It's a part of FreeRepublic Poll Records.

I think there may be just a touch of academic snobbery in his remarks about Miers.

And I think there's more than a touch of intellectual dishonesty and moral cowardice in wantonly attributing such motives to Judge Bork. Can't you Bush hacks meet any criticism, no matter from how distinguished and honorable an authority, of the Miers nomination without making your fulsome "elitism" charge? Have you no decency?

It couldn't possibly be the case that Judge Bork, and the large number of other conservative critics, might be right.

Sure Bork could be right. Or, like his opinion of the 2nd amendment, he could be wrong.

He went on to attend Columbia University in New York City, where he majored in economics. He graduated with honors in 1966, and then enrolled in Yale University Law School, graduating as the class valedictorian in 1970.

He was first a poverty lawyer in New Haven, Connecticut and Washington, D.C. before becoming a trial lawyer for the Federal Trade Commission (FTC). Stein's first teaching stint was as an adjunct professor, teaching political and social content of mass culture at American University in Washington, D.C, and then at University of California, Santa Cruz (UCSC). Additionally, he also held classes on political and civil rights from the United States Constitution at UCSC. At Pepperdine University in Southern California, Stein taught libel law and United States securities law and its ethical aspects. He remains an active law professor at its Malibu campus, having joined Pepperdine's faculty in the mid-1980s.

Stein began his career as a speechwriter and lawyer for United States President Richard Nixon, and later for President Gerald Ford.

My respect for Bork disappeared when he piled on Microsoft with the grand-standing tobbaco-attorney-generals ushering in the 2001 dot-com implosion. Bork reminded everyone of how the rewards of hard work and savvy marketing can be undone by the carping of losers to their elected representatives. Many are much poorer for Bork's poor judgment.
