2nd DeLay charges initially were rejected

Three days after a grand jury turned down a second indictment of House Majority Leader Tom DeLay, prosecutor Ronnie Earle went to a new grand jury citing new evidence and won indictments on charges of money laundering and conspiracy to launder money.

Mr. DeLay and two political associates were first indicted Sept. 28 on a charge of a criminal conspiracy to violate campaign-finance laws and then were indicted by another grand jury Monday on the two money-laundering charges.

But in between, Mr. Earle, the district attorney for Travis County, Texas, tried but failed to get still another grand jury to indict Mr. DeLay, apparently on money-laundering charges.

"We have inquired carefully into the case... and in this said matter, we have failed to find a bill of indictment against him," the grand jurors said in their "no-bill" statement regarding Mr. DeLay and two political associates.

Also yesterday, the foreman of the first grand jury, which returned the campaign-finance conspiracy indictment, said yesterday that his vote to indict was based on TV commercials that he disliked and were run by a Texas business group in 2002 and not on any evidence presented to the grand jury.

We all smarties on Freep knew that this was abuse of prosecutorial power. Now, the whole world will finally find out. The DUmmies will not care of course. They will claim that the right wing is disprespecting law.

My thought exactly. Earle has been after DeLay for - what? - three years, and he just got this "new evidence" for the new grand jury "over the weekend"? Doesn't that seem more than a little peculiar?

Ol' Ronnie is scrabbling for anything he can get.

He is throwing things against the wall to see what sticks, when the only sticky, slimy thing is looking at him from his own mirror.

Probably jealous of the Cindy BullSheehan coverage.....

He went for the charges with the second grand jury without the evidence he got over the weekend.

According to jury members Earle's sole evidence was that delay said he had a general idea of the activities of the group. But delay has consistently said he didn't know the day to day operations. Earle said delay should have said no to them.

Earle is known for not caring about the law, the law is if he thinks it is wrong.

Earle's first charge wasn't even a crime, and the second grand jury rejected him. His third strike will hopefully be when the judge throws out the indictments like he did with kay bailey hutchinson.

The way I read it, Earle tried to get DeLay on the same money laundering charges on three different grand juries. I suppose protection from double jeopardy doesn't count in the indictment process. Besides, maybe triple jeopardy is OK.

The third grand jury had to rounded up hastily at the last minute.Earle could have grabbed ten co-eds off the UT campus and promised them free beer.

I think this is a good thing. Every time the liberals have attacked like this lately they've been knocked two or more steps back on the counter. I say bring it on Earle, we'll throw you in the same dustbin we did Rather.

"My decision was based upon those, not based upon what happened in the grand jury room," William Gibson told Austin radio station KLBJ. "They were stating their positions, and I could state my position by saying I don't like that."

Good grief! Isn't this grounds for dismissal on the indictment and charges against this weasel?
