The forfeiture occurred March 27, 2002, when, in a private act betokening an uneasy conscience, he signed the McCain-Feingold law expanding government regulation of the timing, quantity and content of political speech. The day before the 2000 Iowa caucuses he was asked -- to insure a considered response from him, he had been told in advance he would be asked -- whether McCain-Feingold's core purposes are unconstitutional. He unhesitatingly said, ``I agree.'' Asked if he thought presidents have a duty, pursuant to their oath to defend the Constitution, to make an independent judgment about the constitutionality of bills and to veto those he thinks unconstitutional, he briskly said, ``I do.''

Mr. Will, if you truly and deeply believe this statement, I expect you to call for impeachment.

In fact- if you do believe this- you are obligated to do so.

If not- this is an outrageous statement.

Hate to say it, but maybe we need some "dumb" types on SCOTUS.

The "brilliant" ones are so impressed with their blinding intellect that they believe that international law should be listened to, that the 2nd Amendment doesn't mean what it says, that there are "penumbras" and "auras" and what not...at least someone dumb would not try to pretend that Kelo (eminent domain) or Warwick v Filburn represent genius level reasoning of the court.

I hope most of you can discerna load of elitist horse dung when you see it. Bush dared nominate someone Will doesn't think is "good enough". So this article twists and turns 99 ways to beg the republican senate to dump the president's nominee. this article is horse manure and it's not the first time by Will.

I agree with Mr. Will--although I still reserve judgement on Mrs. Miers. The Court has so badly mismanaged its primary responsibility of interpreting the Constitution that our government has been an effective tyrrany for decades now (a tyrranical government can in fact be benelovent most of the time, as ours has been up to now, but it is nevertheless a de facto tyrrany as defined by the Founders--reading the Declaration of Independence with the current US government in mind is a good way to prove this to yourself.)

Given the dire state of affairs with respect to the mountain of wrongful precedents that have accumulated over the years, there is no more pressing issue before us than the reversal of these abominal precedents and the restoration of the Republic. For that reason, George Will is absolutely correct: the only question that matters is whether the confirmation of Miers as an Associate Justice of the Supreme Court will make any signficant forward progress towards restoring the United States as a Contitutional Repuplic under the rule of law.

The wisdom of presumptive opposition to Miers' confirmation flows from the fact that constitutional reasoning is a talent -- a skill acquired, as intellectual skills are, by years of practice sustained by intense interest.

Eh, George has lost me again. This quote smacks of elitism. I don't think that plain interpretation of the Constituition (a very succinct document) requires special talent, just a little humility and honesty. On the other hand, creative, "living", "prenumbrial" interpretaions and findings are indeed special talents one only finds among the judicial priests and magicians.

I don't really trust the President, I don't think he needs to be so coy. But I'm withholding judgement on this nominee until I detect a lack of humility and honesty or a wiff of that special talent. We probably won't know until we see her opinions. If Roe vs. Wade is not overturned by '08 I think things will go very wrong for our GOP and very probably America. We and the President can live out the rest of our lives knowing it was all our fault.
