Let me put it like this:

Name a single bad nomination that Bush has ever made for anything. The only possible name I can come up with is Norman Mineta. Rumsfeld, Cheney, Rice, Estrada, Brown, Roberts, Ashcroft, the list goes on. Most of the names on every FReeper's short list for this nomination was one of Bush's own picks for the Circuit Courts.

Sorry, I don't buy the out-of-the-box arguement that Miers sucks.

Based on Roberts' past performance on the DC Appeals court and his answers at his confirmation hearing, I'm optimistic.

So am I, but optimistic is not the same as sure. Bush promised Scalia/Thomas and so far we have "trust me" 1 and 2. Maybe they turn out fine, and I'll love them. However, there were better paper trails in the wings. This is just how I feel. I'm just one lone voice at a keyboard, so it really does not matter that much what I think. ;-)

I agree!

Miers is perfect. The President knows her! It's genius. She is far more conservative than any of the others, with a proven, documented track record that does not need to be questioned or debated.

Oh please forgive me for signing up after you did. It makes you so much more worthy. I am not sure what questions you are referring to, however if you have had this tone with her the entire time, I can fully understand why she is trying to ignore you.

is from ABA docs and here is a direct quote from Elaine Donnelly:

According to Elaine Donnelly, president of the Center for Military Readiness, Miers has taken positions as White House counsel that violate the law banning women in combat.

"As While House counsel, Ms. Miers either approved of the Department of Defense's illegal assignments of women in units required to be all-male, which is still continuing in violation of the law requiring notice to Congress in advance, or she was oblivious to the legal consequences of those assignments," she said.

Donnelly believes the actions of Miers could lead directly to a future court ruling requiring women to register with the Selective Service for the draft because they are now being, against the wishes of Congress, assigned to land combat.

until we get rulings from this lady no one will truly know what to expect..and then it will be too late ..perhaps it's too late already..Sad day for Bush supporters.

I'm getting the feeling most FReepers are just POed that their pet nominee wasn't selected.

If you had been a member of The NRA since the late fifties till now you would have known that Orrin Hatch was a closet Rino and always has been. Him and Specter where and are two peas in the same pod.

Orrin has always been extremely sharp in what he does. If you check his voting record you will find he is a strong supporter of the Second Amendment and has received high marks from the NRA.

But if you check what he has done as committee chairman of the Senate Judiciary you will find you have him to thank for the Clinton Assault weapons band.

It was dead in his committee with two weeks left and it was he who brought it up for the committee to vote on knowing if it got to the floor the Democrats had the votes to pass it.

He brought it up at the request of one of his Democratic committee friends and his buddy Specter cast the deciding vote to get it to the floor and then on the floor they vote against it to keep their NRA voting record clean.

This has been a favorite tactic of his on Gun Legislation for twenty years or longer.

if you remember during the Clinton impeachment he and Specter both showed some measure of support for Clinton while speaking to the press.

Ditto here. I just think it's a bit soon for us to be collectively slashing our wrists.

Here's to optimism and perseverance. Slow and steady wins the race. I know that "slow" is maddening, but...

If you click the little mecanical device in your hand on the "to xxx" link it will send you to the post that the previous post was posted to.

If you cannot find it there is a link on FR's homepage to the FR "sand box" for newbies.

If you cannot find that then heaven help you n00b.

He has nominated the rightward most candidate who is confirmable.

Remains to be seen.
Although John Roberts made them look inept, the Democrat senators who will question Miers are serious knife artists, and if they want to they will carve her up and let the media crows feast on the entrails.
VP Cheney says "Trust me" here. While I personally have a Randian allergy toward blank checks of that sort, the Democrats may just take the VP's word for it and accept that she is a conservative. If so, they'll conclude she is an atavistic woman-oppressing fundy fascist, infiltrating the court solely to torpedo their precious right to choose to kill babies.
And out come the long knives. They'll destroy her and congratulate themselves on humiliating the President as well.
I have grave doubts that an evangelical Christian as she is depicted, lawyer or no, will be able to stand before the Senate and successfully avoid betraying her convictions about abortion.
And that's not even getting into the matter of her abilities, but when was the last time this woman was in the hot seat before anyone, never mind the ravening hyenas on the Judiciary Committee?

<*sigh*> I really wasn't paying as much attention then as I am now. But that underscores what I said earlier about Bush having to consider who in the Senate is really in his corner when he nominates someone. I really respected Orrin Hatch, but it pissed me off when I found out that he had suggested Ginsburg. I can sort of understand most Republicans voting for her, even though she is so far to the left ideologically, because Clinton had won the election and therefore had the right to nominate whomever he pleased. That's basically what we're asking the Democrats to do for Bush's nominees, to recognize that Republicans won, and that therefore Bush gets to choose whomever he wants. But there's a big difference between that and actually SUGGESTING Ginsburg as a nominee!

Also GWB was said to have admitted (privately at least) that Treasury Secretary Paul O'Neill was a bad choice. And I don't think Mrs. Whitman was the best either.

As much as I distrust him, I doubt that Orrin G. Hatch was the first to recommend Ruth Ginsburg for the high court. I think he told the Senate Democrat leaders that Republicans would not object if Ginsburg were nominated. And to show his own "bipartisanship," the popular Utah "Republican" co-sponsored her nomination.

Question: No doubt that the Democrats will try to do that, as some on the Left tried to raise Roberts' Catholicism as a potential issue. But can't we do the same thing with Miers that we did with Roberts, and point out that there is no litmus test for religion that is outlined in the Constitution when evaluating a nominee for any court? That's like saying that people who practice certain religions need not apply, and that goes directly aginst free exercise of religion. It should not be allowed.
