What is the justification for passing over Edith Jones, Luttig, Alito, Williams, Sykes, Brown, etc? I put to you that the justification for passing them over doesn't come close to rising to the justification of nominating Miers instead. If the GOP isn't willing to die on a hill like the shape of the future of the Supreme Court, then what hill are they willing to die on?

I think it also sends a very damaging message to conservatives within the legal profession - act too "conservatively" and your career will be limited. The only people who can aspire to the highest position in their field are liberals and conservatives who are careful not to advance the cause too much.

Too bad. It's a real opportunity missed, and the consequences are likely more far-reaching than most realize.

You are right ~ 36 previous SC Justices were not judges prior to being selected for the SC.

Face reality, it's hard to be a pro-family, pro-life SC justice whose going to rollback courtimposed social liberalism if you never married or had kids.

You are sliming someone without knowing their positions. I've never had kids and I'm very pro-life.

Women of Mier's generation who wanted to reach the top of their profession typically didn't have time for a family. It's that friggin' simple.

Notice this happened after the Delay charges came down. He's not the Speaker right now, not a mouthpiece one way or the other temporarily or maybe even permanently.

I'm sure as a fellow Texan, he knows plenty about Ms. Miers. What a coincidence! Ms. Miers in her taped talk from 4/22/05 named a host of candidates whose campaigns she supported.

MIERS DID NOT MENTION SUPPORTING TOM DELAY.

Exactly. Was Clarence Thomas stealthy? Rehnquist? Scalia?
O'Connor and Kennedy had better conservative credentials at the time of their nominations than Miers appears to have.

A fight would have been good. As another freeper noted, a fight would have entrenched a Luttig, Owen or Jones, even more as a conservative after being subjected to the B.S. tactics deployed by the Democrats.

Bushed wimped out; this is a bad pick.

This is probably completely off-base and crazy, but what if Bush thinks another retirement is imminent(Ginsberg) before his term ends, and he is appeasing the Dems for now in order to make a clearer path for a future conservative pick??? It could happen.

I was going to post the same thought. We can hope, anyway.

It's not guesswork. Bush would have asked Specter and McCain and the two Mainers and Chaffee. He Doesn't Have To Guess. He Didn't.

It is we who guess. I provide that analysis as what happens "if". He doesn't have to. They already told him. And note that list is not comprehensive. There could be another GOP Senator or two who is up for re-election who decides saying no to a hardline conservative is a more sure path to re-election.

The problem is, and has always been, that there would be ZERO Dem support for Luttig.

Again, this was not guesswork for Bush. We can't argue with a conclusion about how Senators will vote when he didn't have to guess and we do.

I don't know many people who do that, who aren't Christians, do you?

I know plenty of fine Christian women whom God called to be single, and have done marvellous things for Christ because they didn't have a family to worry about. It has absolutely NOTHING to do with her ability to make policy.

Well, go kiss the ring. You really do want an absolute ruler, don't you. And since I'm not the Senior Senator from Vermont, I know less than Pattick Leahy what's good for this county. And certainly, I should defer on all matters to Bill Clinton since he was twice elected President.

Really lame argument, TTRR!!

Your post doesn't at all reflect how this country works. Often the good sense of the Average American is superior to the political judgements of elected polticians.

I agree with you. This 'gnashing of teeth' is way inappropriate. I have an acquaintance who is a conservative judge, here in North Texas, who told me last week that he was pulling for her nomination. He told me she is quiet, deliberative, honest and a strict constitutionalist. that is what I worked for, and I think most of us would agree, Pres. Bush has been 'misunderestimated' before, I just hate to see this vitriol from here.

I will try to retain an open mind on this pick for now but I must say I would have greatly preferred seeing liberal brains explode over the selection of one of the above, especially JRB. As the SAS say, 'who dares wins'.

Ditto. As observers, the spectacle would have been much more interesting to us if Luttig or some others were nominated. Right now we sound a bit like people who are disappointed in a pick on Survivor or American Idol.
