THE O'CONNOR VACANCY SHORT LIST

See here :

http://www.nytimes.com/2005/09/20/politics/politicsspecial1/20confirm.html?pagewanted=print

The New York Times reports that, "The White House is reshuffling its short list of potential Supreme Court nominees with a new emphasis on finding someone who will hold up under the pressure of what is expected to be fierce confirmation battle..."

This revised criteria allegedly weakens the chances for Judge Janice Rogers Brown. Also on the list is Judge Priscilla Owen, who, "strategists say the White House is evaluating whether her reticence and mild manner would be a strength or a weakness under interrogation in the Senate."

The Times lists the following Judges as also being on the short list:

Judge Edith H. Jones

Judge Edith Brown Clement

Judge Alice M Batchelder

Judge Karen Williams

Judge Consuelo M. Callahan

Assuming what the NY Times is reporting is true,

Lets have a true conservative then --- I nominate Edith Jones.

Here is what the so called paper of record states in part :

--------------------------

September 20, 2005 White House Said to Shift List for 2nd Court Seat By DAVID D. KIRKPATRICK and SHERYL STOLBERG WASHINGTON, Sept. 19 - The White House is reshuffling its short list of potential Supreme Court nominees with a new emphasis on finding someone who will hold up under the pressure of what is expected to be fierce confirmation battle, several Republican allies close to the process said on Monday.

The shifting calculus reflects the increased stakes in replacing the retiring Justice Sandra Day O'Connor as the court's swing vote as well as the expectation that the new nominee will be measured against Judge John G. Roberts Jr., who was hailed by both parties for his performance during almost 20 hours of confirmation hearings for the post of chief justice.

The shift also indicates that the administration expects some Democrats' pent-up frustration with what they labeled as Judge Roberts's evasiveness to spill over into the hearings for a new nominee. Republican aides briefed on the search said the White House was looking mainly at female jurists for Justice O'Connor's seat, but it has expanded its short list and it is examining the contenders anew in the expectation of a trial by fire.

Conservative allies of the White House said the new criteria could hurt the chances of Judge Janice Rogers Brown, a 2005 Bush appointee to the United States Court of Appeals for the District of Columbia Circuit and a favorite of the president's conservative base.

Republican strategists close to the White House worry that Judge Brown, an African-American known for her fiery speeches to conservative crowds, might try to fight back against vigorous questioning. Other conservative strategists say that she also lacks experience on the federal bench and that supporting her highly ideological oratory might strain the solidarity of the Senate Republican caucus.

Another judge said to be on the list is Judge Priscilla R. Owen, a friend of the president also recently confirmed to a federal appeals court after a vigorous Senate battle. In her case, strategists say the White House is evaluating whether her reticence and mild manner would be a strength or a weakness under interrogation in the Senate.

Others said to remain under consideration include the contenders for the last vacancy, Judge Edith H. Jones and Judge Edith Brown Clement of the Fifth Circuit, as well as Judge Alice M Batchelder of the Sixth Circuit, Judge Karen Williams of the Fourth Circuit and Judge Consuelo M. Callahan of the Ninth Circuit. Judge Callahan, a Republican appointee, is Hispanic, and President Bush has made clear that he would like to name a Hispanic to the court.

So I guess the Slimes believes the O'Connor slot is now a spot reserved for females only?

Nominating Marc Levin would soften up the opposition. His barbs at the "honorable" Senators would be sweet!

Jones or Williams only.

And in the interest of justice, let's go with Jones.

Here's an update:

The senators did not identify the prospective justices they suggested to the president. Among candidates widely mentioned are federal appellate judges

Priscilla Richman Owen,

Edith Brown Clement,

Edith Holland Jones,

Emilio Garza,

Edward Charles Prado,

Alice Batchelder,

Karen Williams,

Janice Rogers Brown,

J. Michael Luttig,

J. Harvie Wilkinson,

Michael McConnell and

Samuel Alito.

Notice Gonzales is not on the list.

Can't be done - she has THREE names. Poor Teddy K was barely able to coherently pronouce two names for Roberts. The committee would be deadlocked for weeks while Teddy tries to get the name right.

I agree. GW needs to give them a super conservative to replace Rehnquist because Roberts was the moderate to replace O'Conner. Nevermind the technicals. One moderate and one conservative have left the court, and so far Bush has appointed a moderate being Roberts. Heck, both Specter and Leahy are voting for Roberts and that speaks volumes!

And as far as legacy...the only good legacy Bush is going to have and can ever count on is from fellow conservative base, provided he remains conservative to the end. Do ya think he would ever get credit for "reaching out" to the Democrats? Heck no! So I hope brilliant minds minds at the Whitehouse are convincing themselves to GO Conservative on the next appointment.

I notice that the Times simply assumes that the nominee will be a woman. Maybe so, but I'm sick and tired of all this affirmative action nonsense.

I doubt whether anyone who really knows what is in the President's mind would talk to the New York Times. This is either speculation or propaganda meant to put pressure on Bush and his advisers.

We need to appoint a good, strong, pro-life, strict constructionist, who can be trusted to remain conservative for the rest of his or her life. That means someone who has strong values and enough intelligence not to be wooed by the left-wing press with promises of nice writeups and invitations to trendy cocktail parties with the intellectual elite if only they will change their views.

This second appointment is just as important as the first. We need TWO strong judges, preferably three if another opening appears.

I hope you do not seriously think that Roberts is a moderate.

My assessment: In replacing O'Conner, Williams, Clement, or Callahan would move the court to the left. Jones or Batchelder would hold or move to the right.
