KIRKPATRICK and SHERYL STOLBERG WASHINGTON, Sept. 19 - The White House is reshuffling its short list of potential Supreme Court nominees with a new emphasis on finding someone who will hold up under the pressure of what is expected to be fierce confirmation battle, several Republican allies close to the process said on Monday.
The shifting calculus reflects the increased stakes in replacing the retiring Justice Sandra Day O'Connor as the court's swing vote as well as the expectation that the new nominee will be measured against Judge John G. Roberts Jr., who was hailed by both parties for his performance during almost 20 hours of confirmation hearings for the post of chief justice.
The shift also indicates that the administration expects some Democrats' pent-up frustration with what they labeled as Judge Roberts's evasiveness to spill over into the hearings for a new nominee. Republican aides briefed on the search said the White House was looking mainly at female jurists for Justice O'Connor's seat, but it has expanded its short list and it is examining the contenders anew in the expectation of a trial by fire.
Conservative allies of the White House said the new criteria could hurt the chances of Judge Janice Rogers Brown, a 2005 Bush appointee to the United States Court of Appeals for the District of Columbia Circuit and a favorite of the president's conservative base.
Republican strategists close to the White House worry that Judge Brown, an African-American known for her fiery speeches to conservative crowds, might try to fight back against vigorous questioning. Other conservative strategists say that she also lacks experience on the federal bench and that supporting her highly ideological oratory might strain the solidarity of the Senate Republican caucus.
Another judge said to be on the list is Judge Priscilla R. Owen, a friend of the president also recently confirmed to a federal appeals court after a vigorous Senate battle. In her case, strategists say the White House is evaluating whether her reticence and mild manner would be a strength or a weakness under interrogation in the Senate.
Others said to remain under consideration include the contenders for the last vacancy, Judge Edith H. Jones and Judge Edith Brown Clement of the Fifth Circuit, as well as Judge Alice M Batchelder of the Sixth Circuit, Judge Karen Williams of the Fourth Circuit and Judge Consuelo M. Callahan of the Ninth Circuit. Judge Callahan, a Republican appointee, is Hispanic, and President Bush has made clear that he would like to name a Hispanic to the court.

I notice that the Times simply assumes that the nominee will be a woman. Maybe so, but I'm sick and tired of all this affirmative action nonsense.
I doubt whether anyone who really knows what is in the President's mind would talk to the New York Times. This is either speculation or propaganda meant to put pressure on Bush and his advisers.
We need to appoint a good, strong, pro-life, strict constructionist, who can be trusted to remain conservative for the rest of his or her life. That means someone who has strong values and enough intelligence not to be wooed by the left-wing press with promises of nice writeups and invitations to trendy cocktail parties with the intellectual elite if only they will change their views.
This second appointment is just as important as the first. We need TWO strong judges, preferably three if another opening appears.
My assessment: In replacing O'Conner, Williams, Clement, or Callahan would move the court to the left. Jones or Batchelder would hold or move to the right.
Incorrect premise off the top. Roberts is the replacement for O'Connor. It's Renquist's seat that is still vacant (assuming Roberts gets approved by the Senate).
Consuelo M. Callahan is also Spanish for Souter.
I’m tired of listening to the MSM and the Democratic political establishment – let’s put it out front and center – nominate Janice Rogers Brown and let them go bananas – the majority of this country, and certainty most of those that live between the geographic fringes of the North American continent, are fed up with left wing outrage and non factual rhetoric – colloquial liberal cant (as opposed to traditional liberal cant which I can relate to) has gotten completely out of hand – let the moon bats direct their venom and spittle against an African American female nominee and expose their wretched nonsense for what it is – why not? – it’s the lesser of two evils, either continue to defend against the tide of left wing nonsense or go on the attack – even if she loses the nomination, the country will at least have the chance to be honest with itself – I might even renew my subscription to the New York Times just so see how they justify attacking such a target.
A conservative Black woman is a sure ticket. Let's see "Bullet Head" Leahy or "Fat Boy" Ted, or even "Dead Man Walking" Reid try and dump on her! They do and it's bye-bye Demoncrats.
