Roberts: Day Four Set to Begin

On Thursday, the members of the Senate Judiciary Cmte. continue with a third round of questioning. Then six different panels of out- side witnesses deliver their views on the professional and personal suitability of John Roberts to be appointed Chief Justice of the United States. This testimony will take the entire day.

Martin Garbus, Courting Disaster: The Supreme Court and the Unmaking of American Law (Times Books, 2002)

In his new book Courting Disaster, well-known New York attorney Martin Garbus offers a liberal's appraisal of the current Supreme Court. Not surprisingly, he is deeply dismayed.

Garbus's book is a polemic, albeit one that raises interesting questions about the process of constitutional adjudication. As such, it will appeal to those Court watchers who are interested in the relationship between law and society, and who desire a legal system reflective of liberal values.

Other readers, however, will be left wanting a more balanced consideration of the issues than Garbus provides.

An Acknowledgment of Bias Undermines Any Hope of Objectivity

Garbus, a veteran trial lawyer, makes his position unequivocally clear at the start of the book. Early in the first chapter, he proclaims, "I acknowledge my bias as to what the law is, and what our Constitution stands for." That bias, clearly, is a liberal one - and it inevitably shades Garbus's examination of the Justices and of the opinions they deliver

Right now I am on Court TV, which is having a discussion. I assume they will go back to the hearings after the break.

C-SPAN 1 and 2 are showing House and Senate voting. No C-SPAN 3 on Direct TV satellite. News channels are all on hurricane (old and new).

You are right about the Sharpie, Howlin. Even if it is an accurate picture, however, I DON'T CARE. Reuters is just being juvenile, like when they always tried to get Ashcroft framed by the topless statues.

Court TV cuts in and out -- sometimes in the middle of a sentence -- to commercials and commentary. Nancy Grace is on there now with Lindsey Graham.

Roberts has given an exhibition of class, knowledge and competence the likes of which I have never seen before.

President Bush is no doubt proud and vindicated in his own mind he chose the right man for the job, and so should we also be. My only regret is the rest of the American public will not see every minute (and many not a single minute) of this magnificent demonstration of an American giant surrounded by Democrat Pygmys!

We all can only hope the next appointment is nearly as good. I think Roberts cannot be topped, but it may be close. There is a deep bench to pick from. But, Roberts has embodied the Gold Standard.

I have never seen Nancy Grace in action. Jumping Jehosophat! She first of all tells Lindsey Graham not to call him a judge, because "he ain't a judge yet." (Conveniently ignoring that he IS a judge.) She is griping that these "kings" of the legal system don't have to answer questions, so no one knows how they will think.

How long until the break is over. If it's goig to be a long time, I am switching to hurricane coverage!
