Everyone has considered this constiutional since Eisenhower's day. But now, suddenly, one justice objects. Yet,
in Roberts hearings,
"Thirty-four times this morning, the senators and the nominee mentioned stare decisis -- the Latin term for letting existing precedents stand."
So when it comes to Roe vs. Wade, 'stare decisis' must be the deciding principle. When it comes to the Ten Commandments being displayed, or prayer in schools ( a practice of some 300 years' standing), or the pledge,
the existing precedence means nothing.
