Many Evacuated, but Thousands Still Waiting(still no state of emergency in LA)

Behind the scenes, a power struggle emerged, as federal officials tried to wrest authority from Louisiana Gov. Kathleen Babineaux Blanco (D). Shortly before midnight Friday, the Bush administration sent her a proposed legal memorandum asking her to request a federal takeover of the evacuation of New Orleans, a source within the state's emergency operations center said Saturday.

The administration sought unified control over all local police and state National Guard units reporting to the governor. Louisiana officials rejected the request after talks throughout the night, concerned that such a move would be comparable to a federal declaration of martial law. Some officials in the state suspected a political motive behind the request. "Quite frankly, if they'd been able to pull off taking it away from the locals, they then could have blamed everything on the locals," said the source, who does not have the authority to speak publicly.

A senior administration official said that Bush has clear legal authority to federalize National Guard units to quell civil disturbances under the Insurrection Act and will continue to try to unify the chains of command that are split among the president, the Louisiana governor and the New Orleans mayor.

Louisiana did not reach out to a multi-state mutual aid compact for assistance until Wednesday, three state and federal officials said. As of Saturday, Blanco still had not declared a state of emergency, the senior Bush official said.

"The federal government stands ready to work with state and local officials to secure New Orleans and the state of Louisiana," White House spokesman Dan Bartlett said. "The president will not let any form of bureaucracy get in the way of protecting the citizens of Louisiana."

I have been listening to WLW radio, out of Nawlins (870 am), and it is one big blame-a-thon directed at President Bush and the feds. Caller after caller bashing the lack of response from the president and FEMA. The hosts are actively encouraging the most ridiculous, inane, and stupid crapola I have ever heard.

Not one caller, so far, has even mentioned that Nagen and Blanco have totally failed the people of Nawlins and Louisiana: It is all Bush's fault.

Mississippi and Alabama residents are being short-changed in order to try to save the unsavable, and the ingrates in La. are sucking up all the oxygen, pissing and moaning like a bunch of cry-babies demanding more and more help, and claiming too little, too late.

What a bunch of ingrates these whining jerks have turned out to be. Our tax dollars should be spent to help those that appreciate it instead of these entitlement-spoiled brats that avoid personal responsibility at all costs.

GOVERNOR BLANCO DECLARES STATE OF EMERGENCY

That's an instate declaration, Not a request for Federal assistance. That request for federal assistance is what triggers the deployment of gaurd troops from other states as well as national forces (regular army and navy and airforce).

She called on the interstate compact on Wednesday for gaurd troops from AR and TX, but as of Saturday had still not made a formal declaration of need to the Federal Government.

Memphis, Tennessee is in a red state, but blue county. The mayor is totally incompetent and is reelected over and over.

We had horrible straight line winds that encompassed a huge area(miles and miles wide and long) that took months and months to cleanup and restore, and what did the mayor do immediately after the storm? ran off to a neighboring state for a fund raiser or something on that order.

Fine! I think that G. Bush should call her up and say, Baby it is all yours, then pull all of the feds out and let her hang. How sad that we cannot even have a terrible disaster in this country without a big power fight in the first couple of days.

Am I missing something here? Bush wanted them to request federalization Friday. The feds would then have been in charge. They refused. The locals were in charge during those first few horrible days and now they're blaming the feds (for not being in charge?). And they think if the feds had been in charge, the locals would have been blamed?

It sounds like Alice in Wonderland logic to me. If someone can explain this reasoning, I'm willing to listen.

The whole point of the article is that she hasn't yet declared a state of emergency that results in a request federal aid.

She, at Bush's urging, declared a state of emergency of the type that permits the governor of the state to assume various local powers, activate the local Guard, and then request federal assistance. She appears to have done none of these things - while Nagin is a flake and an incompetent, he clearly wasn't getting any help from Blanco even when he requested it; she didn't have many LA NG in and obviously wasn't letting either them or the cops shoot; she didn't ask Nat. Guard aid from other states until Weds.; and she still has not asked the Federal government for aid, even though it was obvious days ago that the local and state structures and authority had broken down.

The libs have been happily blaming Bush for not taking over from the "get-go."

My brother was doing that while visiting our mother in my home yesterday.

He wasn't "bashing Bush" he said, as he proceeded to lay the blame on Bush's doorstep.

I looked at the meta data in the PDF. It was created using Microsoft Word on a machine with the location tag "LA Governor's Office.

An easy way to generate the same information is to modify the PDF directly, or to reset the computer's clock.

I doubt this is a forgery. There is no way the governor could hope to cover up a forgery anyhow.

Some folks have misinterpreted the Washington Compost article. You will note it mentions a day, but not a date the governor issued an emergency order. Governor Blanco issued a press release on August 26 regarding the in-state emergency declaration. She requested the state be declared a disaster area by President Bush on August 27. That request was granted by President Bush on August 27. He declared Mississippi a disaster area on the morning of August 28 as mentioned in a press conference of the same day. The governor could on her own make requests to other States for assistance, including disaster assistance and deployment of National Guard units.

I admonish everyone to stick to the facts regarding the problems in the path of Hurricane Katrina. Idle speculation and rumors are not what we should be about here. We can rout Dumocrats and DU types easily with hard, cold facts everytime they or their allies in the MSM make a stupid move.

Governor Blanco does not seem to mind being associated with President Bush. On her web site main site, shown here, she is shown pictured with President Bush. The caption at the top of the picture says, quote: President Bush Promises Louisiana Resources, Rescue, Renewed Hope to Evacuees; Governor Blanco Thankful for Help. Other threads on this site have covered extremely well the failings of Blanco and others in this disaster scenario, including some glitches on the part of FEMA as well. I will not expound on those items here. I will say, as has been posted on other threads, that there are disaster support units either on site or on their way to the area hit by Katrina from 48 States, Puerto Rico and Canada. For the purposes of establishing a timeline of the events below, recognize that discussions must have been conducted before these events actually occurred between the interested parties.

The full text of Proclamation No. 48 KBB 2005 is as follows:

WHEREAS, the Louisiana Homeland Security and Emergency Assistance and Disaster Act, R.S. 29:721, et seq., confers upon the governor of the state of Louisiana emergency powers to deal with emergencies and disasters, including those caused by fire, flood, earthquake or other natural or man-made causes, in order to ensure that preparations of this state will be adequate to deal with such emergencies or disasters and to preserve the lives and property of the citizens of the state of Louisiana;

BATON ROUGE—Today Governor Kathleen Babineaux Blanco forwarded a letter to President Bush requesting that he declare an emergency for the State of Louisiana due to Hurricane Katrina. The full text of the letter follows:

Dear Mr. President:

Under the provisions of Section 501 (a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. §§ 5121-5206 (Stafford Act), and implemented by 44 CFR § 206.35, I request that you declare an emergency for the State of Louisiana due to Hurricane Katrina for the time period beginning August 26, 2005, and continuing. The affected areas are all the southeastern parishes including the New Orleans Metropolitan area and the mid state Interstate I-49 corridor and northern parishes along the I-20 corridor that are accepting the thousands of citizens evacuating from the areas expecting to be flooded as a result of Hurricane Katrina.

In response to the situation I have taken appropriate action under State law and directed the execution of the State Emergency Plan on August 26, 2005 in accordance with Section 501 (a) of the Stafford Act. A State of Emergency has been issued for the State in order to support the evacuations of the coastal areas in accordance with our State Evacuation Plan and the remainder of the state to support the State Special Needs and Sheltering Plan.

Pursuant to 44 CFR § 206.35, I have determined that this incident is of such severity and magnitude that effective response is beyond the capabilities of the State and affected local governments, and that supplementary Federal assistance is necessary to save lives, protect property, public health, and safety, or to lessen or avert the threat of a disaster. I am specifically requesting emergency protective measures, direct Federal Assistance, Individual and Household Program (IHP) assistance, Special Needs Program assistance, and debris removal.

Preliminary estimates of the types and amount of emergency assistance needed under the Stafford Act, and emergency assistance from certain Federal agencies under other statutory authorities are tabulated in Enclosure A.

The following information is furnished on the nature and amount of State and local resources that have been or will be used to alleviate the conditions of this emergency:
• Department of Social Services (DSS): Opening (3) Special Need Shelters (SNS) and establishing (3) on Standby.
• Department of Health and Hospitals (DHH): Opening (3) Shelters and establishing (3) on Standby.
• Office of Homeland Security and Emergency Preparedness (OHSEP): Providing generators and support staff for SNS and Public Shelters.
• Louisiana State Police (LSP): Providing support for the phased evacuation of the coastal areas.
• Louisiana Department of Wildlife and Fisheries (WLF): Supporting the evacuation of the affected population and preparing for Search and Rescue Missions.

• Louisiana Department of Transportation and Development (DOTD): Coordinating traffic flow and management of the evacuations routes with local officials and the State of Mississippi.



The following information is furnished on efforts and resources of other Federal agencies, which have been or will be used in responding to this incident:
• FEMA ERT-A Team en-route.

I certify that for this emergency, the State and local governments will assume all applicable non-Federal share of costs required by the Stafford Act.

I request Direct Federal assistance for work and services to save lives and protect property.

(a) List any reasons State and local government cannot perform or contract for performance, (if applicable).

(b) Specify the type of assistance requested.

In accordance with 44 CFR § 206.208, the State of Louisiana agrees that it will, with respect to Direct Federal assistance:

1. Provide without cost to the United States all lands, easement, and rights-of-ways necessary to accomplish the approved work.

2. Hold and save the United States free from damages due to the requested work, and shall indemnify the Federal Government against any claims arising from such work;

3. Provide reimbursement to FEMA for the non-Federal share of the cost of such work in accordance with the provisions of the FEMA-State Agreement; and

4. Assist the performing Federal agency in all support and local jurisdictional matters.

In addition, I anticipate the need for debris removal, which poses an immediate threat to lives, public health, and safety.

Pursuant to Sections 502 and 407 of the Stafford Act, 42 U.S.C. §§ 5192 & 5173, the State agrees to indemnify and hold harmless the United States of America for any claims arising from the removal of debris or wreckage for this disaster. The State agrees that debris removal from public and private property will not occur until the landowner signs an unconditional authorization for the removal of debris.


I have designated Mr. Art Jones as the State Coordinating Officer for this request. He will work with the Federal Emergency Management Agency in damage assessments and may provide further information or justification on my behalf.

THE PRESIDENT: This morning I spoke with FEMA Undersecretary Mike Brown and emergency management teams not only at the federal level but at the state level about the -- Hurricane Katrina. I've also spoken to Governor Blanco of Louisiana, Governor Barbour of Mississippi, Governor Bush of Florida, and Governor Riley of Alabama. I want to thank all the folks at the federal level and the state level and the local level who have taken this storm seriously. I appreciate the efforts of the governors to prepare their citizenry for this upcoming storm.

Yesterday, I signed a disaster declaration for the state of Louisiana, and this morning I signed a disaster declaration for the state of Mississippi. These declarations will allow federal agencies to coordinate all disaster relief efforts with state and local officials. We will do everything in our power to help the people in the communities affected by this storm.

Hurricane Katrina is now designated a category five hurricane. We cannot stress enough the danger this hurricane poses to Gulf Coast communities. I urge all citizens to put their own safety and the safety of their families first by moving to safe ground. Please listen carefully to instructions provided by state and local officials.
