Michael Schiavo Asks Court for Lawsuit Against Terri's Former Caregivers (Schiavo Alert!)

Clearwater, FL (LifeNews.com) -- Terri Schiavo's estranged husband Michael plans to file a lawsuit against her former caretakers. Michael asked a local court on Tuesday to waive the two year statute of limitations against such a lawsuit. Mark Perenich, Michael's new attorney, who replaces euthanasia advocate George Felos, told the Tampa Bay Tribune newspaper he could not comment on the proposed lawsuit.

Under Florida law, legal action must be taken within two years of the alleged mistreatment unless an extension is granted.

Michael could be hoping to go after Florida Governor Jeb Bush or the Florida legislature, which passed Terri's Law in October 2003 authorizing Bush to ask doctors not to starve Terri to death.

Other types of lawsuits, such as libel, have a 4 year filing deadline. Gotta have those ducks lined up in proper sequence ya know..

Sounds just like the mantra of one weird science religion I know.

Kill the unwanted legally then sue the opponents...

Where does one sign up for such a gravy train?

My fondest hope is that his little consort will get out of line, his kids will become teens with all that implies, and then we'll see the fur fly. Just a guess, but don't think his "latest" will put up with a control freak.

Any one know if he's ever bothered to marry and legitimize his children?

Since there has been no recent shortage of people calling the miscreant on his behavior, he wouldn't need an extension of the statute of limitation to pursue libel. He wouldn't pursue any court action that would require him to take the stand and have his honesty challenged.

This is the same man who was kept from any interview except "softball" Larry King. And when he even screwed up on Larry King, he was kept from ALL public exposure. Here's two extracts from his Larry King interviews. In the first (2003) he refused to take a polygraph. In the second (2005) he slipped with "We didn't know what Terri wanted, but this is what we want..."


LARRY KING (October 27, 2003 ) - Michael Schiavo Interview:

CALLER: Hi Larry. I have a question for Michael... why doesn't he just take a lie detector test?

FELOS: The ultimate lie detector has gone before 20 judges who found Mr. Schiavo to be a loving, caring husband.

KING: (UNINTELLIGIBLE) you could voluntarily take one, right?

FELOS: Sure.

KING: Would you take one?

SCHIAVO: I'll refrain from that right now.

KING: OK. This ain't a court.

To equally flippant, I’ve had things more alive in my salad than her. But many on both sides wanted to drag her death 10 years ago out for their own agendas.

Until you can prove that was so, I'll continue to believe we should have erred on the side of life. In any case, depriving anyone of food or water, regardless, is evil.

It was proven to the satisfaction of most. I don’t trust the agenda of those claiming that keeping such a near vegetable breathing for “just” 10 years is evil any more than I trust the motives of another that she be let to die at all cost.

I agree with you that both sides have an agenda..the part I don't agree with is that anything was proven to the satisfaction of anyone.

I agree that there are differences of opinion. But it was proven to the satisfaction of a Judge, one that several other judges refused to consider incompetent enough to overrule. And it was proven enough to satisfy a majority of republican legislators that refused to intervene. And I strongly suspect that if a poll were taken asking if people were satisfied that Terri had no ability to recover after 10 years in a near persistent vegetative state, a strong majority would agree.

I agree Terri would not have recovered..whether someone with her quality of life is legally worth protecting from predators is the unanswered question.

Terri's medical condition was only a threshold issue. The ultimate and critical legal and moral question was whether it was her expressed wish that food and water be withheld under particular medical conditions. When Skeevo only remembered years later, after he scored on the malpractice lawsuit, that Terri told him she would want to die - was he truthful? See post #45

And before you reply that X number of judges/courts believed him or more accurately his lawyers, see post # 8.

The question’s also who has the power to make that decision. Ultimately, it’s a question for society. That means a question of public policy and law. I supported the bill before my legislature in Florida that would have required more explicit notification in order to stop life support. The republican dominated legislature didn’t support it. I believe that was due to their perception that the population doesn’t support keeping people alive for decades in that condition without hope of recovery. I suspect Terri probably thought differently when she was alive, and I also suspect that she would have changed her mind if she sat and watched her crimped brainless body for a decade, but I don’t know any of that with certainty.

All I know is that the people and the state legislature refused to change the laws in favor of overriding her husband’s or the court's authority. I don’t support going around that, and perhaps compromising it, in order to accommodate the moral agenda of a minority. I suspect that Terry got screwed over by her husband, and then what was left of her body got jerked around by people claiming to be acting on her behalf. I wouldn’t wish any of that on my worst enemy.

Remember, Michael turned down a cool million dollar in exchange for releasing Terri. He obviously calculated that her estate would be worth a good deal more than one million. (Which is what I thought too.) Therefore she had to die, for him to maximize his capital gains.

Three hours after she did finally die, Michael was in court with everyone's favorite sadist lawyer, Deborah Bushnell, to file a claim for Terri's estate. Some people let the body get cold before they read the will, but not Michael and Deborah.

It would seem, however, that nobody is offering Michael the megabuck book or movie deal. I suppose diaper service for his little bastard kiddies adds up too. So here comes Mr. Litigious with yet another junk lawsuit.

Hey, Michael, the b*tch is dead now. You said you were going to be rich. Is something going wrong with the plan?

#2 sign of actual justice in this world will be rip-roaring book sales for pro-Terri books -- Cheryl Ford's, and whatever books follow. There will be others -- if I have to write one myself :-) Terri will never be forgotten.

I bought Fuhrman's "Silent Witness," not expecting much and not getting much, but I did want to say "thanks" to him for the effort. We can also appreciate that this is a trained detective looking at the mystery of Terri's collapse -- a view sorely missing. A Columbo is just what we needed. The local corruptos wouldn't even consider that Terri's injuries were caused by an assault (by far the #1 cause of such injuries). Michael is a good boy, y'know. His mom said so before he pulled her tube.

Terri is the title's silent witness. The book was rushed into print and actually appeared before the autopsy report was released. Thus, it could not report whatever witness the autopsy offered.

Now, the autopsy per se didn't find anything much new, but it did cough up some medical records that had been tucked away in a lawyer's office. Since Felos, Schiavo and Greer were at pains to seal Terri's medical records, a criminal investigation of how she collapsed was stymied. But the old records from the lawyer did add some info.

Fuhrman did have one intuition that is worth close attention. Schiavo's accounts of what happened the night of 2/25/90 changed every time he told the story. But there was one constant -- the "thud" of Terri's body collapsing. Fuhrman deduces that MS saw her fall. He didn't just hear her fall. The sound didn't wake him up. He wasn't asleep. He saw it. And of course, he may well have caused her collapse.

Notice that if you or I heard a loud, strange thud sound in the night, we'd immediately suspect there was an intruder in the house. The idea of one's young, healthy spouse collapsing would be so foreign it would never occur to anyone. But Michael's various accounts of things referred only to her collapsing, not to an intruder or anything more ordinary. He knew, didn't he? He knew because he was there when it happened. Think about it.
