Dr. Dean's misdirected outrage
National Democratic Party Chairman Howard Dean frequently blames the world's ailments on President Bush in particular and conservative Republicans in general, at times with such fervor that even fellow Democrats express their misgivings about his rash rhetoric. The former Vermont governor, a physician, delivered a blatant misdiagnosis last week in blaming "right wing" jurists for a controversial June Supreme Court ruling on eminent domain.
Expressing outrage over that decision, which stretched government's reach in "taking" private property to unprecedented lengths, Gov. Dean told the College Democrats of America convention in Washington: "The president and his right-wing Supreme Court think it is OK to have the government take your house if they feel like putting a hotel where your house is."
Oops. The five justices who comprised the majority in that 5-4 ruling were John Paul Stevens, Ruth Bader Ginsburg, Stephen Breyer, Anthony Kennedy and David Souter. The first three are clearly on the court's liberal side, and none of the five can be convincingly called conservative. Indeed, the high court's only three consistently "right wing" members, Chief Justice William Rehnquist, Antonin Scalia and Clarence Thomas, joined moderate Sandra Day O'Connor in voting for the losing, private-property side in the Kelo v. New London case.
By decrying a ruling rendered from the left, Dr. Dean undermined the Democrats' case against confirming judicial nominees from the right. He also prompted many observers on the right, left and in between to wonder again why his party hasn't replaced him.

The article says the first three can clearly be called liberals the article somehow implies that Souter is separate from that group.
It is so laughable when you read how Souter is a moderate.
Dean can't deal with facts.
Like all liberals, Dean is unable to stare reality in the face. The fact is liberals love big government and big taxes. I still can't believe he can lie so easily. I'll know the Kelo decision made many normally power-grabbing-happy liberals unhappy. They just can't accept the fact that their uber-liberal court heroes are the ones responsible.

I think it's because Dean agreed not to run for President in 2008 if he had this job. He'd be more of a detriment in the Dem primary than he would be in this job.
My guess is that they won't replace him until sometime in 2007, when it's too late for him to start a campaign, and still early enough for the voters to forget about him.
