Lawyer: Identity act may not apply in CIA leak case ("must read")

SANFORD: No, I think it's pretty clear that what Karl Rove said to Time magazine's Matthew Cooper doesn't even come close to the kind of knowing violation that is required by the act. Really, the act really requires an intent to harm national security, and that certainly can't be said in these circumstances, I think.

I think a covert agent under the act has to be someone who has deep cover, who is working abroad. Not just traveling abroad, but is stationed and working abroad sometime within the last five years.

And USA Today reported that Joe Wilson's book has even made -- if you do the timeline, the Wilsons were married in 1998. There's some question whether she was even abroad during the last five years.

She really had a desk job at [CIA headquarters in] Langley [Virginia] and was driving in and out of the CIA every day. That's not exactly deep cover.

SANFORD: Well, ... it is worth remembering that when Robert Novak, the columnist, disclosed her identity in his column, he had called the CIA to tell them he was going to do that, and they didn't stop him.

There is another one that drives me nuts, but I can't think of it right now. But, when I hear any of these on TV and the reporter doesn't challenge them, I am pretty vocal about it.

So true.

As a kid tons of my friends had fathers working at NSA and CIA. Matter of fact, an ex-CIA contractor left my office about 1/2 hour ago (that was one of the first things he told me about his work history).

People living around the Beltway are used to this. It's mildly interesting but not remarkable. Only a small percentage are spooks.

But I have little doubt that every cabbie, waiter, and reporter in DC knew about showboater Joe Wilson's wife.

Wilson's report from Nigeria should be considered suspect. A new Nigerian yellow cake report should be quietly comissioned to see if there were any blatant errors of omission in Wilson's report. If it's proven that he skewed that report in favor of finding nothing when there really was something to be found, then I say let him be the first public hanging of the new millenium.

My parents lived in Northern Virginia for years. Their best friends lived next door. We knew he worked for "The Agency." Everyone did. You cannot keep that a secret in Northern Va. You know who works at the CIA, Pentagon, Secret Service and any other government agency.

We all thought he was a pencil pusher as he drove to work everyday and parked in the parking lot.

My parents went to his retirement party at the CIA. Man, were they surprised to find out he was an operative involved in some of the big issues during the past few decades.

The stories told at that party left my parents speechless. (of course it had been more than 5 years, none of it was classified, all of the operations had long been in the public domain, and none of the specifics were discussed).

In all of the years my parents had known him, they never had a clue. No one did. All we knew is he worked at the agency. They (the next door neighbors) kept their mouths shut, had no involvement with the DC elite and no partisan agenda.....

Contrast that with the Wilsons.

Seems to me Rove may have a case for a lawsuit, claiming defamation of character. I can see it on the docket now, Rove vs. DNC.

You may have noticed that Novak hasn't been threatened with jail for not revealing his sources. Fitzgerald knows who told Novak, and, IIRC, Novak will make that info public after Fitzgerald finishes with his prosecution.

The Press was running full tilt boogie with a bogus story that impacted national security and the VP.

He was correcting a story.

Most of the people that work at CIA are not considered secret.
