Lawyer: Identity act may not apply in CIA leak case ("must read")

SANFORD: No, I think it's pretty clear that what Karl Rove said to Time magazine's Matthew Cooper doesn't even come close to the kind of knowing violation that is required by the act. Really, the act really requires an intent to harm national security, and that certainly can't be said in these circumstances, I think.

I think a covert agent under the act has to be someone who has deep cover, who is working abroad. Not just traveling abroad, but is stationed and working abroad sometime within the last five years.

And USA Today reported that Joe Wilson's book has even made -- if you do the timeline, the Wilsons were married in 1998. There's some question whether she was even abroad during the last five years.

She really had a desk job at [CIA headquarters in] Langley [Virginia] and was driving in and out of the CIA every day. That's not exactly deep cover.

SANFORD: Well, ... it is worth remembering that when Robert Novak, the columnist, disclosed her identity in his column, he had called the CIA to tell them he was going to do that, and they didn't stop him.

Last year, Illinois Republicans tried to recruit Patrick Fitzgerald to run against Obama. I think Bush appointed him U.S. Attorney in Illionois. And Googling on him turned up several Illinois newspaper articles identifying him as a Republican. For what it's worth.

That's also the first time I heard this, but wow. If the CIA itself didn't care about Novak's article, what's all the fuss about? This is on top of Wilson's admission on CNN that by July 2003 Plame was no longer a "clandestine" agent. So someone enlighten me: what exactly did Rove do wrong? Or is this yet another classic Rove-a- dope?

I'm beginning to think that the call by the CIA to have this matter investigated might have been the work of another Democrat partisan in the Agency.

I heard the reason she was no longer covert was that a spy had outed her several years before. Can't remember his name for sure, but think it was Aldrich Ames? She got a desk job after that.

Now can we get back to something more important, like why Kerry joined the Navy in '66 and got his honorable discharge in '78. What did he get in '72, when he got out of the Navy? What does his 180 say? Why won't he sign it so we can find out?

Man, I could be a reporter. Ya just gotta ask the right questions.

IMHO, it's the same limp wristed, milquetoast, bunker mentality response that this administration always affords the Democrats. The Dems know they can get 24/7 unoppposed news coverage and W's trustworthiness is taking another hit.

They let them lie millions of times until the lie becomes fact. The greatest disappointment for me has been them allowing the Dems to compartmentalize the Iraq problem to post 9/11. Rove has allowed the moral authority for the war to be stolen and our troops are in greater danger for it.

Just look at the oil situation. Te Dems have blocked any new drilling for decades and have actually forced removal of oil rigs on the west coast. Yet the typical bunker approach has Dubya as the badguy!

What if:

What if two reporters wanted to set up Karl Rove because they needed a source for their article. Reporter 1 tells Rove about a rumor that a wife who worked for the CIA who pulled strings for her hubby.

Reporter 2, knowing what reporter 1 said calls Karl Rove and repeats the rumor seeking a confirmation. When Rove agrees he heard the same rumor reporter 2 uses him as a source.

Interesting way to create an administrative source to information. I bet its been used before.

They didn't call his syndicate. They didn't scream at him, say you're going to endanger her life or [en]danger her career, that sort of thing. They just sort of shrugged and said, "Well, I guess she won't be getting any more overseas assignments."
