I'm talking about what happened behind the scenes there. A lot of Republicans didn't want him confirmed, and they were content to let the Democrats "bork" him because it helped these Senators stand up for him in public even though they opposed him -- which carried a lot of weight with the GOP base.

Social Conservatives, having helped change the political landscape over the last ten years with deeply held convictions, will leap from "passionate" to "passivity" in a nano-second IF Bush nominates to the Supreme Court anything less than a "Strict Constitutionalist!"

I agree with you that those will definitely be all out war. However, I think the 4 liberals will do their duty, unless health issues absolutely overcome them, and wait until GWBush is gone from the presidency before they retire.

O'Connor, though, is the swing seat in the 5-4 Court. More often than not, she has voted as a liberal. There will be more blood in the water over O'Connor than any we have ever seen....to include Thomas.

If the President could appoint a strict constructionist that America already knows to be a wonderful person, that would make it that much more difficult for the Rats. (The war would then default to the Rehnquist retirement.)

The social conservatives threaten and know they can bring down any republican. But they are not the only people in this tent.

As if country club Republicans could ever win anything on their own.

i have no idea if he will feel beholden to replace like with like. that is a horrible trap to fall into, IMO, ie; the jewish seat, the woman's seat, the black seat etc. it then becomes like an affirmative action paradigm instead of a court.

You don't understand how a legislative body works, do you? A number of those 40 Republicans only voted to confirm him because they knew he wasn't going to be confirmed.

I second your comments on social conservatives. Look at their recent example where they demanded an activist court when rulings didn't go their way.

They were interviewing Judge Edith Clement recently, under the radar conservative from the 5th Circuit.

15 years as a federal judge, solid, competent, not flamboyant in any way.
If GWB nominates a woman, that gotta be her.
