The Demonrats would like the right to convert the Republican young in college classrooms on environmentalism, sexual license, bleeding heartism, pseudo-intellectual mock superiority, repulsion for war and (gasp!) guns, etc.

THAT is not a challenge.

The chief justice gets to shape coalitions through the assignments of the cases.

Constitutional law is a tricky business and the justices often will influence one another over one legal nuance or another. Moreover, though each justice of course hears and decides on all the cases misses an essential point: the human element, the personal chemistry among the justices. It is really no different than who gets to sponsor a bill in the Legislature; that person, and the approach he/she takes, will obviously influence others.

Jack Valenti, the popular former LBJ aide who served for years as chief lobbyist for the Motion Picture Assn., told CNN Friday afternoon that President Bush must name a clone (not his words)of Sandra Day O'Connor to the Supreme Court to succeed Mrs. Justice O'Connor. Valenti hailed O'Connor for being able to "bridge" left and right on "these social issues." He did not say that O'Connor's bridge was usually to one side, the left one! His sparring partner, venerable Robert D.S. Novak said Bush must name a real conservative to the vacancy.

After the Supreme Court hears a case, they meet privately and take an initial vote. The Chief Justice, if he is in the majority (or the most senior justice in the majority, if the Chief is in the minority) assigns one justice in the majority to write the opinion for the Court.

"Strict Constructionists" do NOT apply the IntStComm clause to backyard vegetable/home consumption businesses.

Scalia may want to reconsider his respect for stare decisis in the light of the eminent domain case (esp. after CFR).

Of course, a ruling restricting the commerce clause to its original meaning might in effect be a full-employment-for-lawyers bill: wouldn't about 87% of things (for want of a better word) be "ripe" for a new try?

It means that the chief justice gets to assign the lead writer to the majority opinion after the justices caucus over one case or another. The person who gets that appointment will often influence others one way or another based on their respective logic, their writing, legal precedent, and stream of consciousness.

There is an old saying that is applicable across government: people are policy.

McConnell didn't pass my smell test either. He was against Gore V Bush and he was against Clinton impeachment.

Would a lawyer please weigh in on the issue. I think impeached means accused or charged. Sittin thinks it means successfully convicted.

Impeached means formally charged by a majority vote of the House of Representatives. Convicted means convicted by a 2/3 vote of the Senate.

Of Presidents, only Andrew Johnson and Clinton were impeached; neither was convicted. Nixon was about to be impeached-- the House Judiciary Committee had unanimously recommended one article of impeachment, and had recommended two others by big margins-- but he resigned first.
