Posted on 06/24/2005 7:17:30 AM PDT by tenn2005

Today, June 23, 2005, the Supreme Court totally defied history, abdicated their duty to insure justice, ignored our Constitution and trashed the rights of We the People by depriving us of our right to private ownership of property.

Interesting enough most on the left and right are abhorred by the ruling. Why they are abhorred is different, but the SCOTUS seems to have alienated a great majority of the populace on this one.

The ruling is indefensible, but what can be done in the short term to reverse it?

It is a tragedy that is very telling, that McClintock is STANDING ALL BY HIMSELF ON THIS. Where in the hell are the Repubs? I guess they really don't care about the Constitution. What else can one assume?

"The ruling is indefensible, but what can be done in the short term to reverse it?"

Nothing, our Robed Rulers have ruled.

Until the making of such unconstitutional decisions becomes uncomfortable to the persons making the rulings, nothing will change.

Someay soon, somewhere, government will push and those being pushed will puch back.

Liberty and self-governance are not scary things in the hands of trustworthy people.

If the matter were in the hands of trustworthy people, the decision would have been 9-0 in favor of property rights.

Indeed, a trustworthy people have no need for laws at all. They are a law unto themselves.

Ted Kennedy's land could be used for a substance abuse facility or a prison for 1st degree murderers.

Whine and complain all you want, but I'm speaking reality, and it's time some people here GET IT.

Reality: "squatter's rights" have become entrenched as an "American" concept of just use of land. That's a fact.

Reality: Property taxation is viewed as a reasonable means to prevent land barons from "enclosing" land like they did in England.

Reality: we have had for 200 years a fairly UNBROKEN support of "developmental rights" over "pristine property rights." (Note that the environmental whacko cases invoving bugs or owls do not involve concepts of "pristine property rights" vs. developmental rights, but of "endagered species" vs. developmental rights). So you can complain that it's "nibbling" or whatever phrase you want to use, but I suggest it's a more productive use of our time to address the legal issues in the TERMS THAT ARE BEING USED, because we can win on those issues. It's like trying to fight the term "gay" anymore. It's pretty much a lost battle.

The decision stinks, but I see a single ray of hope. The court left to the individual states the right to address the issue with legislation. That is the Republican form of government guaranteed in the Constitution.

Too bad more people in our nation have little exposure to California State Senator Tom McClintock. Now here's a person that would be a great Supreme Court judge.

Some may not agree, but from my perspective as a Californian that has been watching him, President might even be a good descriptor, 2012??

The rats are just a front group for this operation.

It's the globalist ruling class and the UN that want us all disarmed.

This is outrageous!

The government can now confiscate your home and personal property for the economic good of others.

This is SCARY

Yes, it sure is SCARY, and it's called COMMUNISM!!!!

I'd agree with you. He needs national exposure. I don't view him as political, but a man of great honor earned by staying true to his convictions. When he gives his word, he holds to it.

Yes ... we've moved beyond socialism to Communism (by force).

Sometimes I have to pinch myself because it's getting surreal out there and you don't hear much outrage from the sheeple. They're too busy entertaining themselves to death and taking antidepressants and God knows what else to avoid reality.

I've only heard crickets.

Does anyone have a clue as to where the homes of the five communist "justices" are located?

I would suggest that if one knew these locations, it would be worth filing against their homes with the intent to develop commercial centers for generating tax revenue for the local counties and/or state.

Maybe that should have been done BEFORE the decision!
