Guinea Pig Parachute Won't Lead To Cruelty Charges
19-Year-Old Already Paid Civil Fine
POSTED: 12:22 pm EDT May 25, 2005
BLOOMINGTON, Ind. -- An Indiana University student is cleared of animal cruelty charges after a December skydiving stunt involving a parachute and a guinea pig.
Nineteen-year-old David Feldscott was accused of taping a parachute to the rodent and sending it out an eighth-floor dorm window.
He and some friends told police they were planning to retrieve the guinea pig when it reached the ground, but that plan failed when the animal got stuck in a tree.
It was rescued and placed at a local animal shelter, where it acquired the name Noel since it was the holiday season.
The judge dropped the criminal charge against Feldscott because the student had already paid a $500 civil fine.

Correct. The civil fine was considered punitive. A separate criminal charge would have violated double jeopardy principles, and the Indiana Constitution's double jeopardy provisions are more stringent than the U.S. Constitution's protections.

However, it's not cruel to starve a human animal to death, civilly or criminally.

Cruelty to animals?
Things like this make you wonder how many people, judges included, have the slightest idea how the hockey puck on their McDonald's hamburger got there.

Oh for gosh sakes! Are the police now going to go into scientific research labs and free all the mice and monkeys? In the 1950's we were launching mice, cats, dogs and apes into space to see what effect it had on life. And Homer Simpson brought an ant farm with him on the space shuttle (they got loose and mad a big mess)! I think seeing if one could engineer a parachute for a guinea pig would have a certain scientific value to science/engineering students.
We're turning into a nation of wet blankets.

Remember the show WKRP when Les Nessman dropped the turkeys from the helicopter?

It grows in WAL-MART trees.

Hmmm.
Meanwhile, over in the biology lab, guinea pigs are routinely dissected.
Seems to me that if the kid had written a paper about his experience, he could have defended it as research.

I would pay for a modified clay pigeon launcher that threw small mammals into the air for target shooting. They make a satisfying squeak when they disintegrate.
(Yes we are allowed to own rifles here.)
