Rush says deal fell apart. Dems offered to give up or down vote on all 7 current Appeals Ct. nominees, and that they wouldl only use future filibuster on "extreme" candidates or under "extraordianry" circumstances.
The problem -- how do you define "extreme" or "extraordinary"?
