That and the fact that she's a successful, (probably considered) wealthy Christian. A plate like that on a BMW? Come on! That's considered a target in a place like Washington State, Right? ;)

Does the complainer even know what John 3:16 says, other than it is a religious message to those in the know? Would there be the same treatment if the license plate said:
EXOD20:3REV22:12 (for a more positive message)
It seems to me there has to be some knowledge for this to be of some offense.

The courts have ruled on these things over and over again. If the state opens up a public area for speech, they cannot discriminate on certain speech because of the state does not approve of its content except in very limited areas (obscenity, public safety, and the like).
Its the same principle as opening up a public park for protests for abortion. If they do that, they cannot completely exclude anti-abortion protesters because that would be favoring a certain content and discriminating against another. They stand no chance really if all the precedents hold, they can only hope for a freak judge...who will then get overturned.
