DONALD -- Police arrested two teenagers Friday on suspicion of felony murder in the fatal shooting of a husband and wife who reported a burglary earlier in the week at their next-door neighbor's house, police said.
Gale Goode, 48, and Becky Goode, 47, were killed Thursday in their rural ranch home just outside this northern Marion County community of about 600 people.
The suspects -- Jorge Ybarra, 19, and Emanuel Lopez-Delgado, 16, both of Salem -- were among three teenagers found in a car that witnesses saw leaving the street where the Goodes lived.
Sheriff's deputies backed up by Oregon State Police chased the car on Interstate 5 and found that Lopez-Delgado and a 14-year-old boy inside had been shot.
The younger boy was in stable condition at OHSU Hospital in Portland. He hasn't been arrested.
Lopez-Delgado was treated for his wounds at Salem Hospital. His case will be handled in adult court, said Deputy District Attorney Stephanie Tuttle. He is being held at the Marion County jail.
Ybarra also faces a first-degree burglary count and is being held at the Marion County jail.
Sheriff's officials haven't released many details on what happened at the Goode home or how the teens were shot.
Marion County Deputy Kevin Rau said two burglary calls came in to the sheriff's office this week about burglaries at a house next to the Goodes' home. The neighbor first reported an overnight burglary on Wednesday, he said.
Then on Thursday, Becky Goode called 9-1-1 and reported two boys jumping over the neighbor's fence and running away, Rau said. She told dispatchers that her husband went outside with a gun, but by then the two, along with a third man, had escaped.
Felony murder is a Measure 11 crime that carries a maximum sentence of life in prison.
Ybarra and Lopez-Delgado both face arraignment next week.

So was this a revenge murder for reporting a crime? Or was it homeowners protecting their property? The story isn't clear.

Per the article the maximum is life in prison. And anyway, per the Supreme Court, these fellows are too young to be executed.

Yes but it is never used, at least in the Portland-Salem I-5 corridor. For instance we tried and convicted LeDon Stephens a serial-pedophile and rapist who killed a 14 year old girl after raping her. He got life in prison, despite victim testemony that included girls he had molested and raped all the way back to junior high. He was about 30 when he finally got life without parole.

It appears that because the robbers knew they had been seen (and challenged) by the armed homeowners next door to the house they robbed they returned the next day to murder them.
It's not clear if this was due to worry about being identified, because the home owner had wounded one of them, or their sick gang machisimo.

Oregon does have a death penalty. Not sure this crime is a DP one. It is rarely sentenced and almost never carried out.

In 1984 two initiatives were passed: one amended the constitution, exempting the death penalty from the constitutional prohibitions against vindictive justice and cruel and unusual punishment; the other essentially established the current death penalty statute.
The Oregon Supreme Court, after remand of State v. Wagner II, 390 Or. 5 (1990) from the U.S. Supreme
Court, invalidated the death penalty but held the statutory defect could be cured by adding an instruction expressly informing the jury of its duty to consider all mitigating evidence and its responsibility to determine whether the defendant deserved a sentence of death
The Legislature subsequently amended to statute to provide such a question for the jury which allows it to consider a broad range of mitigating evidence.
Records since 1903 show that 60 men have been executed. Two have been executed since 1962: Douglas Wright in September 1996 and Harry Moore in May 1997. Both men refused to appeal their sentences.
On 10/11/1999 twenty-five men were listed on death row.
Hopefully at least the oldest of these men can join this short list.

The crime we're discussing in this thread involves 1) multiple killing, 2) obvious premeditation and 3) commission of murder during perpetration of another felony, home invasion. What does a criminal have to do to get the death penalty in that state?
A backlit keypad on a landline phone with a speed dial and speaker phone to 911. Hit it and talk as ya pick up yer 12 ga. A cellular phone left on the nightstand as a backup to the landline is ideal.
Secure the access to their homes so a door has to be kicked or a glass has to be broken for anyone to get in.
A small nervous little barking pup to "warn" the homeowner vs defend the homeowner. Also the pup will or can backup any installed alarm system that may have been disabled or malfunctioned.
Purchase a minimum of a revolver in 357 caliber so training or familiarization can be done with .38 specials to work up to the .357 magnum loads. A revolver cylinder is easier to open that a slide on a semi-auto is to function for most users. Plus there are systems in place such as the magna trigger to make it useless for all but the homeowners who wear a special ring. This is good if you have small kids, who are too small to train properly or visitors who may discover a firearm an do something silly with it. We have 4 such firearms "stashed" around the home, all of a common caliber with the magnatrigger option and each will function only for me or the girl friday.
Also a 12 or 20 gauge double barrel shotgun. The double barrel from EAA called the bounty hunter II is a good choice for the layman shooter be they male or female or if one or the other spouse isn't knowledgeable of firearms. The double barrel can be broke open and loaded or inspected easily to see if it's unloaded. Mine has one of the little Uncle Mikes nylon stock socks that holds 6 spare rounds and I leave the 12 gauge loaded for a total of 8 round available to me quickly. Key to the break open shotgun and the revolver is that older or weaker folks or those who don't shoot everyday will be able to use or ready and inspect the firearms easily under stress. One spouse may be a tactical hero but for any firearms for defending the home from criminal invasion the type and selection should be consider for the lowest level of ability of the persons in the home that may need it. The very short legal lenght barrels of the EAA BHII make it ideal for indoor use. We modified some millwork in our home to hide 4 of these. So regardless of where we are in the home we're just a few steps away from the self defense tools.

Well you all are doing better than NJ, we've got a DP but we haven't executed anyone. Nor is there any public pressure to do so, not than I'm aware of.
