DeLay Raises Possibility of Trying to Impeach Some Judges in Schiavo Case

House Majority Leader Tom DeLay on Thursday blamed Terri Schiavo's death on what he contended was a failed legal system and he raised the possibility of trying to impeach some of the federal judges in the case. "The time will come for the men responsible for this to answer for their behavior," said DeLay, R-Texas.

But a leading Democratic senator said DeLay's comments were "irresponsible and reprehensible." Sen. Edward Kennedy, D-Mass., said DeLay should make sure that people know he is not advocating violence against judges.

DeLay, the second-ranking House GOP lawmaker, helped lead congressional efforts 10 days ago to enact legislation designed to prod the federal courts into ordering the reinsertion of Schiavo's feeding tube. He said the courts' refusal to do just that was a "perfect example of an out of control judiciary."

Asked about the possibility of the House's bringing impeachment charges against judges in the Schiavo case, DeLay said, "There's plenty of time to look into that."

President Bush expressed sympathy to Schiavo's parents.

"I urge all those who honor Terri Schiavo to continue to work to build a culture of life where all Americans are welcomed and valued and protected, especially those who live at the mercy of others," he said.

White House spokesman Scott McClellan refused to join DeLay in criticizing the courts. "We would have preferred a different decision from the courts ... but ultimately we have to follow our laws and abide by the courts," McClellan said.

Joining DeLay in taking issue with the judiciary was Sen. Rick Santorum, R-Pa., who said, "The actions on the part of the Florida court and the U.S. Supreme Court are unconscionable." Also, GOP Rep. Patrick McHenry of North Carolina said the case "saw a state judge completely ignore a congressional committees subpoena and insult its intent" and "a federal court not only reject, but deride the very law that Congress passed."

DeLay said he would make sure that the GOP-controlled House "will look at an arrogant and out of control judiciary that thumbs its nose at Congress and the president."

In such a suit, the District Court shall determine de novo any claim of a violation of any right of Theresa Marie Schiavo within the scope of this Act, notwithstanding any prior State court determination and regardless of whether such a claim has previously been raised, considered, or decided in State court proceedings.

Ah. I understand. Sit down. Shut up. And vote for us once every two and four years.

If we don't, you have the right to blame an election loss on us. If we do, you dismiss we were essential to victory. I understand perfectly. I understand there is real bigotry against Christians among some in the grassroots of the Republican Party without which Republicans would no more be in power than they would be without any of the other core constituencies.

Sounds to as though you are the one that cannot be depended on. So stop the hypocrisy by complaining about the 'religious right' possibly not being supportive when clearly you, yourself, cannot be depended on when you don't get your way.

The door hasn't slammed shut on the Nuke option, not that it matters. Reps or Dem the Judiciary is out of control. The real option isn't more judges but to have power restored to its proper balance, and that only can happen through the Congress.

They create the law under which the rules of procedure are derived.

No, they create the law only. They do not have any power to alter rules of procedure. That's exclusively a court power. The only way to change that is by Constitutional amendment. An act of Congress is not enough. Changes to rules of procedure can only be done by Constitutional amendment.

for Judicial murders of the innocent?

I am suspending donations to the GOP until such time as I am satisfied that they have taken steps to prevent a repetition of this fiasco. I am not going to work GOTV in 2006 if the religious right remains in the driver's seat. And, if the Terribot mob doesn't cool it, I won't even bother showing up to vote. And the GOP is going to hear about it in detail.

Well, the Dems must be yucking it up just fine today. They pulled off a huge victory by the deliberate death of someone who did nothing wrong.

Their victory is splitting up the GOP coalition, and the emotions of some on this issue was their tool.

Separation of powers. It was fine for Congress to give the federal courts jurisdiction over the case, but when they began specifying how the court should hear the case they went too far.

It would be like the courts ordering Congress to have X number of people on a committee and in what party ratio.

Wait a minute here. The liberals have a point. Bush signed a bill in Texas allowing the decision to pull the plug to be more streamlined, and allegedly gives the state a say when an indigent family disagrees! Also, DeLay's family pulled the plug on dad. I am curious as to whether or not that has been discussed here, or Bob Schindler making the same decision for his own mom. Sometimes it has to be done.

I have a question for those who don't think we should have government funding of health care for the indigent--should poor people be allowed to die or will you pay for it? There is a good question for conservatives that needs to be answered.
