However, it's extremely problematic that higher courts consistently affirmed Greer.

However, the reason they have, IMHO, is because their hands are tied due to the laws on the books. I have to credit them for one thing though - they ARE following the law, and not acting based on their own personal feelings...

It's a toughie, alright...

Like in 2000, Clinton could have said to the Supremes "this time you don't have final authority". I'm not great on constitutional knowledge. But I just can't think of a way to run a country when we discard judicial rulings whenever we think it is important enough.

Oh! Significantly, the executive is subject to an election every four years - the judiciary is not. This gives the decision of the executive more weight even if the legislature was neutral, because the executive is answerable to the people, and the judiciary is not.

Sure we can. However, what we lose is the ability to hold them accountable, because if we allow it when we agree, and not hold them accountable because it's "the right thing to do" regardless of the legality, then we have zero recourse when it occurs for something we disagree with...

Yeah I anticipated the accountability objection... hence my previous post to you in which I addressed that, noting the executive is accountable by election, but the judiciary is not. Thus if accountability is your concern, this should cause you to favor the executive over the judiciary, not the other way around.

If you're right about this (and I think you well could be), then part of the problem, at least, is that we have crap laws on the books.

Theoretically, that's fixable. In practice, not terribly easy. But among systems of government, ours give the most hope for being able to repair itself through the will of the people.

But it can only be done by an informed electorate.

So, sites like freerepublic and talk show hosts like some of the good ones we have, become the means for justice in America.

There is a flaw, that I can see. There seems to be very limited ability to review the fact-finding process on appeal. The state legislature could address that I suspect.
