Michael Schiavo Files Request With the SCOTUS, USSC Refuses to Take Schiavo Case

Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.

Some of the laws are bad. No doubt. The court here is outrageous. The higher courts in FL are disgusting. FL is rotten to the core. I love the State, my late Aunt and paternal grandparents lived there. I have enjoyed my stays there. But the gov. and bureacracies are rotten.

Even the Gov. has shown his lost confidence. "I'm not sure we can get it done here in Florida," Martinez quoted (Gov.) Bush as saying just after a new Schiavo measure stalled in the Florida Legislature. "Do whatever you can federally."

I don't know...at least we're not home to Jesse Jackson, and our GOP candidate for Congress did not have to withdraw from the race after the fact that he'd asked his wife to participate in group sex parties surfaced, which of course was quickly followed by the "I am not a carpetbagger in spite of anything I've ever said" campaign by a "principled" conservative with a propensity for sticking his foot in his holier-than-thou mouth when is comes to defining the evils of "selfish hedonist" lesbian offspring.

THat's the point - in the absence of knowing what she wants, the bias should be for life.

When the Courts threw out the Texas sodomy laws, they acted under that principle of acting on how they "felt" about a law.

That was judicial activism, and it is exactly what you described.

I am simply observing what the law says about who gets to decide.

Michael Schiavo gets to make the decision according to the law.

You are so willing to let word games and legal sophistry allow this woman to be killed. I want to know WHY. Why would a person I would ordinarily consider moral, be arguing in favour of this utterly evil nonsense that someone can be done away on such shaky grounds. For God's sake, WHY?!?

That was judicial activism, and it is exactly what you described.

I just pointed out Judge Greer was the one engaged in judicial activism. Moves in contra to it could be considered against judicial activism.

So, your decision about your son (God forbid) under similar circumstances should be overturned by the opinion of a politician trying to attract votes from the pro-life movement?

Michael Schiavo gets to make the decision according to the law.

It's obviously not that clear cut otherwise it would not have taken this long. Second, there are people who are willing to stand up and say that she should live. Third, there is conflicting medical evidence about whether or not she can recover. In the midst of such a haze, you are so bloody happy to say she ought to die, rather than having a bias that she should live.

The haze around this case should give pause, not cause her to be starved to death.

Following the letter of the law, and not taking action contrary to the law based on the fact that the Judge considers the law to be a "bad" law is Judicial activism?

Taking action against a ruling of a Judge who is engaged in judicial activism could be considered an action contra to judicial activism.

Not as long as she is legally married.

A spouse and ONLY a spouse can divorce the other.

On your profile it say - may Cuba be liberated soon...

Why don't you just let the law in Cuba stand as written and you should feel it must be respected too and not try to change the situation in Cuba?

But you believe in changing that law - don't you? And we, who are for Terri and life - believe in changing the law too.
