ACLU of Florida Welcomes Judge Whittemore’s Ruling in the Schiavo Case

March 22, 2005

Statement of Howard L. Simon, Executive Director of the ACLU of Florida

MIAMI, FL -- Today Judge Whittemore found that even with the special law passed by Congress there is no basis to set aside the legal procedures in Florida for how these difficult, but intensely personal decisions are to be made. Both Congress and the President needlessly prolonged this tragic saga.

Decisions about whether to continue or discontinue extraordinary or even life-sustaining measures are part of a basic privacy right, and should be left to each of us when competent to make those decisions, or through a surrogate if no longer competent, but certainly without the intrusion of politicians who may not approve of our decision.

The President, no doubt, will continue to talk about a "culture of life," but what Judge Whittemore did in his decision was to defend the "culture of freedom" that each of us has to exercise control over our lives, and the circumstances of our own death.

There is a lesson for all of us in the tragic Schiavo case: if you want to exclude politicians from the end-of-life decisions you and your family must make regarding a terminally-ill loved one or, as in the case of Terri Schiavo, a family member who has suffered a catastrophic accident; if you don't want to be used as a political cause celebre by political and religious organizations - express your end-of-life views to your family and loved ones and, better, put it in writing in the form of a living will or advance medical directive.

NOTE: The ACLU was co-counsel in the case before Judge Whittemore that resulted in today's ruling....

America is filled with groups that think they are gaining something for themselves, whereas they are setting themselves up to reap the whirlwind. Liberals think they are protecting "individual rights" but their actions have and will result in the deaths of millions. Women's groups sought to liberate women and instead have consigned them to work, death in battle, immorality and even death by husband. Minority groups seek gains with affirmative action and hate crimes laws, but they are creating a racial basis for laws that will someday be used against them, because race is always a dangerous basis for any action.

But sadly, everyone is dancing drunk to these "victories." Most Americans want Terri Schiavo, unwanted babies, and a fight for real justice put out of their minds. It's all too embarrassing, too difficult, requires too much work and thought in a throw away society.

Americans think they are doing Terri's parents a favor, because the grim truth is most Americans don't want to - and don't - care for their loved ones under extreme circumstances. We have more government aid for the elderly, and more nursing homes to dump themn in, than ever befrore. It's not because we are poorer and can't afford to care for our loved ones at home. It's because we're richer than ever before, more "free" - and we want to stay that way.

And in the end, in Brave New World, everyone becomes disposable. Nobody complains and the ones who are gone can't complain.

Just in time for Easter!! The judge asked whom shall I let live Terri Schiavo who has not been convicted of any wrongdoing or the (fictional) murderer/rapist/thug Barrabas? The mob chants "Barrabas, Barrabas". What shall I then do with Mrs. Schivo? "Death to her and let her blood be on our heads". Thank you liberals. Thank you ACLU. Thank you Judge Whitmore. Have a happy Easter.

Stop The ACLU Coalition is planning a nation wide protest on every ACLU office in America. Go sign up for the newsletter. Just email Nedd. His email is on the front page. We are also planning on creating newspaper ads, and eventually commercials exposing the ACLU.

ACLU Applauds. Nice to hear. Oh wow! When is the big party planned?

Will the ACLU be having rump roast at the honorary dinner for Terri's death? Balloons and a comedian?

How about having Micheal be the quest of honor instead of a comedian and he can just repeat, "That B*tch is dead Jim" for all of their amusement.

You know, I have seem some of the most specious arguments about this case, (and some from freepers who I had previously respected), but this one takes the cake. From the ACLU no less!
