[history]
Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.

I missed Hannity because I get home from work after him. The problem with all of that, is that none of it is reversible error. There was lot's of testimony and it was all considered. Wolfson appears to have been a very effective expert. That is why Congress did the de novo thing. Gibbs somehow missed the thought that maybe that should have some impact on how he framed his complaint in federal court. I think that was because it was written some time ago, and well, he just didn't have time to well, type in another count. One would think he would have filed an amended complaint today, based on Whittmore pointing out his problems. One would think.

If she is Roman Catholic, cremation is no longer against her religion. There may be some conditions placed upon it. When our child was cremated, the cremains could not be brought into the church for some reason. But it is permitted.

It doesn't look that way.
I'm wondering if the 11th circuit treated it like a DE NOVO complaint.

But we can't if she dies.

well Lanny Davis was out defending Terri. I'm not certain if this is because they fear it'll cause backlash on H.C., or if their hearts are in the right place. I'd like to think the latter.

I will ever believe that 12 persons woudl agree with Clear and Convicing Evidence that on this day, Terri Schiavo would decide to be starved to death. I jsut don't believe 12 people will agree with that. Jury Trail is her BEST Hope, if she gets to live long enough to have one.
Look at O.J. he got off. Look how suspecious we all are of motive, on mIchaels part. I do have faith in a Jury Trail for Terri.
This is what a denovo would help Terri to have...a trial by Jury, but we need that tube in so she can live to see it happen
To: ruoflaw
He treated it as a de novo proceeding, but was trapped by the complaint in deciding the liklihood of success on what was plead, which is an essential element when granting a preliminary injunction.

It's a no brainer, as was the original correct decision in this case.

If this is the actual ruling and is not yet released, it seems to indicate that the appeal is approved and sent back to circuit judge YET the order to insert the feeding tube is not.
If true they are bouncing it back and forth to run down the clock and make it moot when she dies. Disgusting pos judges.

I just skipped to the end of this thread. Am I understanding that the 11th circuit might issue their decision soon? As in an hour or two? Am I reading that correctly?

Oh, how I wish I could get to Florida to support the Shiavos. I don't understand that commumity at all. In my town of 20,000 people, we had way more protestors fighting the ACLU over our Jesus Paintings in our park at Christmas time then there is fighting for Terri down there. There should be real shame about that.
