Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.
Thanks for the reminder of why we are praying for hearts and minds.
At this purely awful time, Lord, please strengthen our own hearts and minds as we need it the most. Be with Terri. Please don't let it end here, please do not let evil triumph in this. Please raise up people from within the community to give their testimony for Terri, continue to open hearts and minds to understand what is truly at stake here. Strengthen us all, Father; we rely on Your care, Your compassion for Your little ones. In Jesus' Name, Amen. Through tears.

Holy Father you are a fair and just God and we need you to turn the hearts of those that are not acting fair and just right now. We need the power of the Holy Spirit to come upon the people that are making decisions today concerning the life of your child and our sister Theresa Schindler Schiavo and make convict them to err on the side of life and not murder. Please hear our cries my Lord...for only YOU can set Terri free from the grip of Satan that is trying to grab hold of her and kill her.

The Schindlers' supporters in Congress passed a weak bill, where the provision for mandatory temporary relief was erased.
Then to compound the infirmity of the quickly-passed law, the Schindlers' attorney neglected to raise the Schindlers' strongest arguments for temporary relief.
As other posters have indicated, Gibbs needed to submit that Terri Schiavo is not PVS. Instead, he needed to argue that Mrs. Schiavo is a disabled woman whose federal rights under the American Disability Act are not being respected.
His second strong argument would be that even if Terri were PVS, she never left clear, written directives about removal of a feeding tube. Therefore, under federal case law (see Cruzan), her wishes must be ascertained using a very stringent standard. Such standard could only be met after a de novo review of her wishes is conducted on federal court.
I agree with you, that at the end, the Schindlers would have lost in federal court. Nevertheless, they had a chance for temporary relief that was wasted by their attorney, Mr. Gibbs.
Did anyone see on Fox that out of 10 people who were arrested for civil disobedience, 3 OF THEM WERE CHILDREN?
How young were the children, does anyone know? What have we turned into??
Read the 11th circuit decision, and then come back and tell me that you still believe that. Gibbs simply wrote a complaint not framed in de novo terms. The lower court federal judge, Whittemire (sp) was properly constrained by what was in the complaint. The federal courts competently carried out their responsibility in good faith in my considered opinion (and it has been considered).
Who cares, that is something none of us can change...criticizing another lawyer is not the answer(that is if you are professing to be a lawyer)
