Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.

BREAKING FROM PINELLAS COUNTY:

Apparently, per wfla radio 970, "The police force today has a major presence at Hospice." (imo that's because Hospice is updating them on Terri's medical condition but the Schindlers aren't told Terri's true condition.) THE COPS ARE GETTING MEDICAL UPDATES AND ADJUSTING THE SIZE OF THEIR FORCE ACCORDINGLY. I think they are talking to hospice minions inside and they all have little walkie talkies so they can play BAD COP.

I don't think these liberal federal courts would have decided for Terri no matter who argued what before them. It is a stacked deck. There is no need to blame Terri's lawyers. Not one of these judges have been motivated by the truth but rely on process and procedure.

The pleadings complained about how the case was handled, and posed unpersuasive constitutional theories. It did not say in the pleading that Terri did not want to die in this circumstance, and was not PVS, as just an allegation.

Gibbs, the Schindlers' attorney, might have committed legal malpractice. After reading his original pleading, I have to agree with you about his weak arguments.

Gibbs rehashed the old state case, mentioning Greer profusely on his legal briefs.

Even worse, today the Eleventh Circuit gave Gibbs a chance to appeal to the whole court (en banc) if he submitted legal briefs by 10 AM today (March 23, 2005). The deadline already passed.

Obviously, Gibbs disregarded another opportunity to amend his pleadings to the appellate court and raise the plain issues you suggested.

Now the SCOTUS has little to work with in order to grant relief.

I have been trying to call Jeb Bush's office but all I get are busy signals. I hope this is a good sign. I don't know why he just doesn't go in there and grab Terri. Geez, I live in Illinois and saw Daley close down Midway under the cover of darkness and bulldoze it with planes on the runway. Jeb ought to do the right thing and worry about the consequences afterwords. The people who will be pissed off never would vote for him anyways.

Whittmore literally screamed out the roadmap for Gibbs. Gibbs needs to contact his malpractice carrier.

That first footnote on Whittmore's opinion says it all. Gibbs did not connect the legal dots needed to create a successful argument.

I hope the appeal to the SCOTUS is better prepared.

I agree and I have looked over his pleadings as well...and believe me he has other experts helping him....this is a case of judicial "bonding" sort of like how cops have that "brotherhood" thing....only this time they are playing with an innocent person's life

He has really dropped the ball. I told him I am moving from Florida and never looking back. I told him he had a year and a half to do something with DCF to get her out of there.

If she passes (oh God, I hope not), it will be on his watch, his hands. Plus, you have the activist judges who didn't follow the VERY SIMPLE LAW PASSED SUNDAY NIGHT!

God hasn't said "no" yet, and I believe He wants me to pray for the good for as long as there is hope. Talking about the possibility that God will say no to our prayers undermines our commitment to pray. I vow to pray as long as Terri is alive that Terri will be SAVED. God is not going to expect me to read His mind and know that His answer will be no. Even when God answers "no", it doesn't mean He himself is necessarily pleased by the outcome. Michael Schiavo's people are lecturing us about how we should give up and be happy Terri will soon be in a better place. I don't take theology lessons from murderers. I shall pray for Terri's life as long as she still has one and I believe it is God's will that we pray for this. The devil wants us to give up, but I never will.
