Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.

Your statement is the unvarnished truth...right to murder indeed. Neither most of the public nor the judges see it that way at this time, though, and what does that say about them? Shudder.

I've seen at least some of the legal code in the last few days, so it isn't just pulled out of someone's hat...Florida state law allows a court to determine a person's wishes not just from living wills, but from statements by those who knew her, and requires some proof that the person is in PVS. The problem is that the Judge didn't listen to evidence that we feel he ought to have, although evidently he was within legal, although not morally good, bounds doing so.

It's a set of laws that make sense if, for example, it was the loving husband of a frail woman who was dying from ALS refused to put her on a ventilator as she entered her last stages, even though she never wrote anything down but they had discussed what to do next, or perhaps had had a massive stroke.

Where it becomes bad is when you have a spouse who doesn't want you to live for selfish reasons, or you just have brain damage, but are basically healthy.

And it's made more evil since food and water are considered extraordinary care, rather than mormative care, under the state law.

Therefore, someone taking advantage of the system can pretend you didn't want to live, and then painfully kill you, because they have the right as guardian to determine that. And the hospices keep the fiction of dehydration being painless, when it's not, because it speeds up their little death factories, and may make patient care management a little simpler.

No...its not, they are still appealing to the state legislature and they are trying to get an investigation into some things pertaining to Michael and the allegations (which are actually in affidavit and police report form) that have been made against him.

Indeed and God help us all. This is a horrible precedent. Why would any of our lives be protected? I suppose this can be one way of eleminating our Medicaid/Medicare problem. We can simply say that when a person gets to the point they cannot any longer feed themselves, they simply starve to death and the problem is solved.

Too late...Greer would not even let this nurse's accusations be part of the trial record. And that is what is running this whole case. The de novo portion of the statute is totally ignored in favor of the record as Greer created it. If Napolitano doesn't get that, he's more clueless than I thought. Judges should be hearing it...OF COURSE THEY SHOULD! DUH! But that deck was stacked long ago, and the judicial branch refuses to give Terri that new trial, in direct contradiction to the new law.

Are you saying that by statute it is legal to starve people in FL? Why would anyone want to retire there?

I am not sure...I don't know the FL statutes....they have weird laws in FL

Thank God that Terri's parents have stood their ground on this and fought so hard for her, or we may never have known about these atrocities being committed. Let's keep praying.

Who knows how many others are there we don't know about? I heard the decision at 3 this morning and just couldn't bring myself to log on.

Why does it matter which court? They all rule against the Schindlers. I think they know the end is near for Terri. What good would more hearings in Atlanta do? Felos would just appeal to the Supremes if Atlanta en banc were to miraculously rule for the Schindlers, so it would go to the Supremes anyway.

Thanks so much for your explanation but then this tells me that in FL, at least, one should have a living will stating that you do NOT want to be starved and thirsted to death because otherwise they can.

Seems those unsuspecting seniors living in FL should be warned about this.

They are going STRAIGHT to the Supreme Court. I don't think that's a good idea. I hope I'm wrong!

That's the next stop and the end of the line.

We should be focused on Plan B right now while continuing to pray for justice at the US Supreme Court. The best solution at this point, in my opinion, is for President Bush to have the same courage to act that President Clinton did in the Elian Gonzales case. It's time for our side to go on offense. An open, and characteristically strong, letter from Michael Peroutka points out the way:

Dear Mr. President And Governor Bush:

Greetings, friends, in the blessed Name of our Lord, apart from Whom we can do nothing (John 15:5). We write to both of you as fellow Christians and beseech you, respectfully, to do everything within your considerable power to keep Terri Schiavo from being murdered in cold blood.

The New International Version translation of Proverbs 24:11-12, referring to those who are innocent, reads: "Rescue those being led away to death ... If you say, 'But we knew nothing about this,' does not He Who weighs the heart perceive it? Does not He Who guards your life know it? Will He not repay each person according to what he has done?"

Explaining this passage from God's Word, the great Puritan Bible commentator Matthew Henry says that it requires "a great duty" from us, "that is to appear for the relief of oppressed innocency," that we ought "to bestir ourselves all we can to save them ... If any [innocent person] be set upon by force or violence, and it be in our power to rescue them, we ought to do it."

This Proverb, of course, applies to all of us. But, all of us do not have it within our power and ability to rescue Terri Schiavo, to stop her from being murdered in cold blood.

You, Mr. President, and you, Governor Bush do, however, have this power. And we intend no presumption, sirs, when we tell both of you that you must exercise the power you have to save Terri Schiavo's life because God commands you to do so and your oath of office makes it your affirmative duty!

Both of you have the power and ability to stop the murder of Terri Schiavo. If you do not act and use the power you have, her innocent blood will be on your hands.

Here, please, are some of the things we think both of you have the power and ability to do right away:

--- You, Mr. President, could order Federal marshals to be sent to guard Terri Schiavo, have her feeding tube reinserted, and arrest anyone who attempted her murder by removing this tube. If her case goes all the way to the U.S. Supreme Court, and the ruling there is to take her feeding tube out, ignore this ruling and leave the Federal marshals there as long as is necessary to keep her from being murdered. Any court ruling that orders murder is illegal and binds nobody.

--- You, Governor Bush, could do, basically, the same thing --- order your relevant law enforcement personnel to take Terri Schiavo into protective custody; order her feeding tube to be reinserted; and arrest anyone who attempts to murder her be removing this feeding tube. And if any court, at any level, orders her feeding tube to be removed, ignore this order because no court order that orders the murder of anybody has any validity.

Mr. President, Governor Bush, you are men to whom much has been given; thus much is required of you. We pray fervently that you do your Christian and Constitutional duty (remember your oath) and act now to save the life of Terri Schiavo.

The Schindlers are being treated like garbage, there would be no Terri if not for them and yet the A-Hole Schiavo has all the rights here and he is the one causing her death.
