Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.
If this goes to Kennedy for instance, Terri is DOOMED.
It doesn't JUST go to Kennedy, but before it goes to the justices at all, the WOC has to be granted, and so I am not sure if Kennedy alone makes that determination (it supposedly goes to him first) or if he takes a vote among all the justices as to the WOC (Writ of Certiorari)
The FL legislature is Terri's best bet...I don't trust the courts to do the morally right thing on this at all.

The T-4 Euthanasie Programme of the Third Reich was responsible for 250,000-300,000 murders of disabled people. It started off with just one case - that of the Knauer baby whose father begged the Chancellor for permission to kill him. The child was born with profound defects and the father felt he would have (say it with me, now) NO QUALITY OF LIFE. Hitler gleefully gave his blessings, the kid was iced and the laws producing the T-4 Programme were put in place.
Historians have called the murders of T-4 the leading edge for the Holocaust. So....

3. 6,000,000+ million souls
Now:

This isn't a right-to-die case. It's about the right to commit murder.

LegalEagle: I was lying in bed this am thinking, under what FL LAW is Terri being starved and thirsted to death? Is there such a law or does this show the power of just one judge being able to create law whereever he, or she wants?
I am not sure as I do not profess to know FL law, but i am sure that if this is violating a FL statute that Terri's lawyer would have already brought that out....and used it

An article published today clarifies the SCOTUS procedure:
"An emergency filing to the high court that seeks to reinsert Schiavo's feeding tube while the case is litigated would go first to Justice Anthony Kennedy....
Kennedy, who has staked a moderate position on social issues, would have the option to act on the petition alone, although on previous emergency requests involving Schiavo he has referred the matter to the full nine-member Court.

Atlanta denied the Schindler's appeal. A three judge panel, by a 2-1 vote, ruled that Terri can be killed. They ruled that the Schindlers failed to show that they have a substantial chance of winning if they are given a de novo trial, and so they can't have one. Sorry to have to tell you. I am shaking inside like a leaf in a cold wind.

Are you saying that by statute it is legal to starve people in FL? Why would anyone want to retire there?
Fox is reporting about the nurse now....and the fact that she is accusing him of injecting Terri with the insulin...finally it is coming out...and even Napolitano is now in shock and saying that this is stuff the judge should be hearing about....on right now
Going to SCOTUS is the only thing left.
