US House of Rep. in an Extraordinary Sunday night Session [Schiavo] (Bush Signs Schiavo bill)

This is an unprecedented session. The Congress is meeting to save one persons life (in real time).

The only reason the Democrats are agreeing to this is that they don’t want to be known as the party that killed Terri.

This is American history happening before your eyes.

saw the original House bill (HR 1332). It was riddled with all sorts of damaging precedent.

Why the term "precedent" in this case? I was under the impression that legislative bodies are there to make law. Shouldn't concern about "setting precedent" only be relevant to judicial bodies.

Yes! Aren't we supposed to be able to go to our elected Representatives and Senators with problems, and if legislation is needed, they write it? And we are supposed to go to the judge and have them know what laws are available, and apply them to our case?

At the time that Terri entered her present state of severe disability, Florida law did not define providing food and water as "extraordinary measures." The law was changed in 1999.

Thus, your argument is not only factually correct, but legally correct. There is no reason to believe, factually OR legally, that she would have consented to removal of food and water.

Unconstitutional? Don't quit your day job.

The 5th and 14th Amendments to the Constitution provide that no person shall be deprived of life without due process of law.

This bill gives the parents the power to initiate a brand new lawsuit in order to ensure that their daughter is not deprived of life without due process of law.

De novo means, in this case, a new record.

Which precedents will the court overrule?

We need some case law here.

BTW, toward the end of the Civil War all of these Souvrn' courts got disestablished. In fact, one of my GGGrandfathers got to set the torch to many of them.

Seems to me there's some pretty heady precedents in that!
