WASHINGTON With the sparsest of attendance, the Senate unanimously passed on Sunday a bill to try to help brain-damaged patient Terri Schiavo (search) by pushing her case into a federal court for consideration.
The Senate is poised to recess for spring break unless the House of Representatives fails to pass the bill, in which case it would reconvene on Monday.
Earlier in the day, the House of Representatives met to vote on Schiavo's fate but quickly recessed after it became clear that the bill would face congressional debate by opposing Democrats. The House was meeting at 9 p.m. EST to start debate, and House leaders said they hoped to get a vote on the matter as early as possible after midnight.

Excerpts of a bill passed Sunday by the Senate and under consideration by the House of Representatives in the Terri Schiavo case:
"The United States District Court for the Middle District of Florida shall have jurisdiction to hear, determine, and render judgment on a suit or claim by or on behalf of Theresa Marie Schiavo for the alleged violation of any right of Theresa Marie Schiavo under the Constitution or laws of the United States relating to the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain her life."

"Any parent of Theresa Marie Schiavo shall have standing to bring a suit under this act. The suit may be brought against any other person who was a party to State court proceedings relating to the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain the life of Theresa Marie Schiavo, or who may act pursuant to a state court order authorizing or directing the withholding or withdrawal of food, fluids, or medical treatment necessary to sustain her life.
"In such a suit, the District Court shall determine ... any claim of a violation of any right of Theresa Marie Schiavo within the scope of this act, notwithstanding any prior state court determination and regardless of whether such a claim has previously been raised, considered, or decided in state court proceedings. The District Court shall entertain and determine the suit without any delay or abstention in favor of state court proceedings, and regardless of whether remedies available in the state courts have been exhausted."

It was a voice vote. So no-one had to go on the record other than the Senators who were there. Handy, eh?

The House debate is supposed to start at 9PM. Hopefully it will be on C-SPAN.
Even leftist rat bums understand the majority of the American public is behind Terri, and not in favour of the fanatics demanding her slow, nazi-like death.
I believe he went on Larry King and got that whole nightmare rolling.
In the House, on the other hand, such unanimous consent could not take place today. Three members of the House were willing to object publiclu, to that vote. Therefore, a rule on debate WAS passed. The debate will end at midnight, tonight, and the vote will take place immediately afterward.
So, the bill will go to the President for his signature, shortly after midnight. I am certain that in Florida the federal court clerk has already been contacted, and a judge is tentatively assigned. Odds are, the legal papers will be filed in federal court in Florida, and a judge may act on the matter before dawn. Expect news on this case when you get up in the morning.

Not yet. Even if the House votes for this bill and the president finally signs it, IMHO the die has been cast. I have a gut feeling that a medical condition was created during the removal of the tube to cause death by means other than dehydration or starvation, thus holding all the murderers blameless.
I hope this story gets lots of play in the senior care arena. I'm sure that those in elder-care would feel real warm and fuzzy over democrats wanting to "Off" a women who can speak, eat, and recognizes her family. Maybe they can interview Dick Gephart's mom who he dragged into the presidential debate from her nursing home?
Such a provision would avoid having the case assigned to a single, federal trial judge. As I know from personal experience, there is at least one wild-hair judge on every federal court everywhere. (On the D.C. District Court, the wild-hair I had to deal with was Stanley Sporkin. LOL.)
