I think Greer is just doing unthinking analysis of the situation. In other cases the husband would have the final say so ends the analysis. He does not see the need to consider the other aspects which the law provides to show a husband decision is colored by outside circumstances.

The analysis of why this is an exceptional circumstance must be done throught the standard analysis of an incapacitated married wife/husband. The question and what is most alarming about this case is that it points out the limited legal ability of judges. Book smarts mean nothing, law in a vacume without facts. Legal knowledge must work at applied to the facts of the real world.

Where are all the noisy Democrats who recently took to the Senate floor blathering about saving the lives of carribou in Alaska??

I think Feinstein has been busy with her Horse Slaughter Bill. (She wants to make sure that the bodies of dead American horses aren't sold overseas to people who eat horseflesh)

As Americans, most of us were shocked to learn that this odious, ugly and gut-wrenching practice even exists. Why? The reason is simple. Horse slaughter, or the slaughter of our pleasure, nonfood animals, is not and never will be part of our culture.
So, on the one hand, "horse slaughter should not be part of our culture," but, on the other hand, starving helpless humans is part of the future that the liberals beholden to the ACLU have in mind for us.

Right now, the law presumes do all in the absence of documentation to the contrary. I think attorneys like felos want to change the presumption to death.

You hit the nail on the head. The "legal presumption" in incapacity cases is what's at stake here, and it's a HUGE issue that goes way beyond Terri. Florida law says that the judge must presume against withholding feeding, unless there is clear and convincing evidence that that's what the patient wants. AS a Florida Internation U. Law Professor wrote in the Miami Heral last week, obviously there isn't "clear and convincing" evidence that Terri would want to have nutition and water withheld. All they have are ambiguous statements, offered into evidence as hearsay, annd there are statements that go both ways. So in the absense of clear evidence pointing one way, you don't withhold the nutrition. The law prof. wrote that it was "shocking" that greer had order nutrition withheld, on such flimsy evidence. Essentially, as you say, he's turned the presumptions on their head - - he's presuming for death, not for life. If this is a change that society is going to make, the legislative branch must do so - - NOT the judiciary. Felos seems to want to get it done through the courts.

That sums it up nicely!

I was downstairs and heard this on FOX News. Ran around the house screaming and shouting and praising the Lord God Almighty.

Then these absolute morons started talking about how it's unconstitutional and how Terri's fate should be in the hands of her husband. I called FOX News to complaint 1-212-301-3000 but they just make me sick!! Earlier in the day, the guy sitting in for Tony Snow said the feeding tube is in Terri's ARM FOR GOD'S SAKE. HOW COULD ANYONE BE THAT DUMB IGNORANT AND MISINFORMED. Those people don't know squat about Terri's situation and they act like they do. It's absolutely DISGUSTING!!!

I also called the White House and left a message there.

I'm on a hunger strike in solidarity with Terri.

Not giving up hope yet.

Perhaps the order of Congress needs to go to the actual, hands on killer. It might come down to which consequences that pit of an institution fears the most...those of a pathetic little god wannabe in a black robe, or those of the entire US Congress (with a few predictable exceptions), fully supported by the president.
