Well, it does seem unconstitutional. I mean, isn't that why some think there would have to be a constitutional amendment against it for it to remain illegal? I understand how people can say they hate it, but I don't think they have a leg to stand on when it comes to the question of whether it is constitutional or not. You have to mandate something that makes it okay not to extend equal rights that aren't covered by some other thing like harm to others.

These judges need to get off of their "I'm God and I can do whatever I want" seats. We seriously need to do massive impeachments.I'm with you on that one. Time for the whole state government to get some serious reality adjustments.

This judge just decided that the people of California are 'irrational' and should have no decision in policy making. He decided that the non-deviant people of California are irrational.

BUT .. THERE IS A STATE CONSTITUTIONAL AMENDMENT IN PROCESS AND IT HAS RECENTLY CLEARED ANOTHER HURDLE.
This judge's decision will probably cause this amendment to be more widely supported.

A judge ruled
Stunning that one judge can overrule the people of California.
It's beginning to look more and more like the ROME of old. A lot of Julius Caesars and Roman emperors ruling over good folk!!

Probably is the 9th Circus! So my guess is that it will be appealed and on appeal it will be turned around. This 9th Circuit is so liberal and pathetic!

A pair of bills pending before the California Legislature would put a constitutional amendment banning same-sex marriage on the November ballot. If California voters approve such an amendment, as those in 13 other states did last year, that would put the issue out of the control of lawmakers and the courts. We need to support these efforts:
Senate
MEASURE: S.C.A. No. 1
AUTHOR(S): Morrow.
TOPIC: Marriage.
HOUSE LOCATION : SEN
TITLE : A resolution to propose to the people of the State of California an amendment to the Constitution of the State, by adding Section 7.5 to Article I of the California Constitution, relating to marriage.
Assembly
MEASURE: A.C.A. No. 3
AUTHOR(S): Haynes.
TOPIC: Marriage.
HOUSE LOCATION: ASM
TITLE: A resolution to propose to the people of the State of California an amendment to the Constitution of the State, by adding Section 7.5 to Article I of the California Constitution, relating to marriage.

Here is what our Thomas Jefferson warned us about
"The Constitution... meant that its coordinate branches should be checks on each other. But the opinion which gives to the judges the right to decide what laws are constitutional and what not, not only for themselves in their own sphere of action but for the Legislature and Executive also in their spheres, would make the Judiciary a despotic branch." --Thomas Jefferson to Abigail Adams, 1804.
