Well, it does seem unconstitutional. I mean, isn't that why some think there would have to be a constitutional amendment against it for it to remain illegal? I understand how people can say they hate it, but I don't think they have a leg to stand on when it comes to the question of whether it is constitutional or not. You have to mandate something that makes it okay not to extend equal rights that aren't covered by some other thing like harm to others.

This judge just decided that the people of California are 'irrational' and should have no decision in policy making.

He decided that the non-deviant people of California are irrational.

BUT .. THERE IS A STATE CONSTITUTIONAL AMENDMENT IN PROCESS AND IT HAS RECENTLY CLEARED ANOTHER HURDLE.

This judge's decision will probably cause this amendment to be more widely supported.
