TAMPA, Fla. - Terri Schiavo's parents asked a Pinellas court judge Monday to allow her to divorce her husband - in either life or death - in a court filing accusing Michael Schiavo of adultery and not acting in his wife's best interests.
The filing was one of a flurry of 15 motions filed by Bob and Mary Schindler as they now have less than three weeks to find a legal way to keep their severely brain-damaged daughter alive.
Terri Schiavo is scheduled to have the feeding tube that has kept her alive for 15 years removed March 18 unless her parents can convince an appeals court to block Michael Schiavo again. Michael Schiavo says he will have the tube pulled because his wife once told him she would never want to be kept alive artificially.
David Gibbs, the Schindler's attorney, said Pinellas Circuit Court Judge George Greer has indicated he will not hear the divorce request and five other motions filed Monday - but that only means that the matters are now on their way to being appealed to the 2nd District Court of Appeal in Lakeland........

Boy, what is it going to take for Jeb to see that Greer is a criminal and if Terri dies he should be charged with murder as well as MS?? No, not surprising to me either that he won't hear the divorce issue.

Thing is Terri would surely ask for a divorce from MS if she could knowing he is living with another women, and having children with her. Even if Terri was to get better Michael wouldn't stay with her. So, I think a judge should conclude that a divorce is granted because of Michael already being "married" to someone else!
Nor should it be a surprise to anyone that a judge won't hear a request by a wife for a divorce when the wife hasn't ever requested a divorce - or have you actually reached the point where you just don't care how it is done, as long as what you want is done?

In many states, a husband living with another woman with whom he has 2 children would constiute grounds for automatic divorce. It's ridiculous and absurd.

Yeah, for all the phony talk from Michael Schiavo about what Terry's "wishes" would be, who can question or doubt that, with her husband living in open and notorious adultery, she would wish to divorce him? And, given the fact of the two children born into this adulterous relationship, I can't imagine any sane judge even entertaining the idea of the outcome being contested.
She is unable to so so. Both because her estranged husband is her guardian and because she is physically unable. Do you know any able bodied woman who would remain married to her husband under such circumstances?

Now, you want a court to assume how Ms. Schiavo would feel and act under these circumstances and take legal action based upon that assumption - exactly the kind of thing so many have criticized the courts for with regard to her feelings about life support.
No, my friend, what you really want is outcome-driven judging. Just what the intellectual left has been arguing in favor of for two decades. And if you get it, the most basic foundations of the common law justice system are gone.
This is one case. It is one person. It may be tragic, but you can't rewrite the entire system to suit your feelings about this case.
