However, even if there were grounds, show me a state that ever allowed divorce by proxy.

Particularly when said proxy did not hold a valid power of attorney.

To clarify my last. All 50 states allow no fault divorce. 35 of those state are no fault only. The remaining 15 have no fault as an option.

ahh.... but there is just as much heresay testimony that Terri WANTED a divorce, AND most likely told him so that night of her 'accident' ... as there is heresay testimony that she wanted to die instead of having a 'feeding tube'.

...NOW who is unwilling to treat both conditions the same way?




....other things (to ALL), I have been spelling Brodersen wrong,
....and I stubled upon some old charts we did of glaring differences in court testimony regarding 'the accident'

I have the feeling you are correct. I'm guessing hubby is in a hurry for two reasons: his ladyfriend and the fear of what Terry'd reveal if she regained speech.

A Church anullment is also in order.

The Church cannot grant an annulment without a civil divorce. In addition, Terri would have to petition for the annulment.

A Catholic annulment has no bearing on a civil divorce.

Cannot the Catholic Church dissolve Terri's marriage to Michael? Would that then be recognized by the civil courts?Maybe this is a stupid question, but putting it out there anyway.

If my husband cheated on me I might be able to forgive and go back to him, but if that affair created 2 children I'd be divorcing him right away and I'm sure most women would do the same!

That is not what people meant. I think it was said in error.

As far as I know the state with the fastest divorce is Nevada...3 weeks.

Anyone know different?

What I think others on the board is saying is that there would be no problem getting a divorce of the basis of adultery, no "proof" to sift through.

Now, the adultery is a conflict of interest as her guardian and that is grounds for AUTOMATIC REMOVAL of the guardian.

I still say you live with your head in the sand. You don't see it, so it must not be true. You are no where NEAR being informed about this.

You are posting against veterans of this cause who have examined just about all there is on this case.

However I was thinking the other day that I would not like to see them divorce....I want to see Terri's parents gain full custody of her, full guardianship. A divorce would free Michael to marry his mistress.... A part of me would like to see Terri deny Jodi what Jodi has been waiting for for years!

I'm curious, but do the children of this union figure into this at all, or are they dismissible because you don't like the parents?

Your post says a lot - in particular your contention that I am "posting against veterans."

I'm not posting "against" anyone. I think the guy's claims are suspicious. But he might be telling the truth. And we have a thread full of "veterans" - typical of threads on this topic - who lambaste the judge for refusing to do things he has NO legal authority to do, like granting a divorce because her parents, who don't have the legal right to do so, asked for it. We also have people hear advocating perjury.

I suspect that most of you "veterans" wouldn't accept Michael's approach even if Terri had said exactly what he claims.

It's not a stupid question, since there is a great deal of confusion about Catholic annulments.

The way you say that- are saying that not wanting to see Jodi get her sleezy hands on the money that is supposed to HELP Terri would mean someone is DISMISSING Jodi's kids? TERRI is the one wronged here! Trying to defned Terri and keep the woman sleeping with her husband from getting rich and living high off of Terri's THERAPY money in no way even BEGINS to suggest ill will towards The kids of Terri's, Husband's Mistress... (wow- that last sentence paints a real good picture of just how demented this ENTIRE case is.) Judge Greer is DISPICABLE!

Give me a break Melas, the kids are as much victims in all of this as they have terrible parents. But this case isn't about those kids as they will live, it is about Terri!

Michael doesn't have a piece of paper stating that Terri wished to have the tubes pulled. (Common sense would err on the side of caution, therefore, absent a document stating such, Terri should be treated as at least equal to the prisoners in Abu Gharib; or animals in an animal shelter.)

And Judge Greer doesn't have a piece of paper stating that Terri would want a divorce from the man who is adulterously living with another woman, having children with that woman. (Common sense would tell me that she would, however.)

Judge Greer does, however, have a piece of paper, called a deposition, from the 1992 civil court hearings, wherein Michael Schavio stated HE WANTED TO TAKE CARE OF TERRI FOR THE REST OF HIS LIFE, and because of his "clear and convincing" testimony, Michael and Terri were awarded $1.2 million so that Michael could take care of Terri for the rest of HIS life. Michael Schaivo did not say, during that court hearing that Terri wouldn't want to live the way she's living (she's been living worse since Michael received the money to take care of her).

That's a great point. Apparently Judge Greer only chooses heresay that supports death.
