THE NEW YORK OBSERVER will report tomorrow: 'Former 60 Minutes Wednesday executive editor Josh Howard has told colleagues that before he resigns, the 23-year CBS News veteran will demand that the network retract remarks by CBS president Leslie Moonves, correct its official story line and ultimately clear his name'...

In the event of a lawsuit, Mr. Howard has told associates that he would like to see Moonves put under oath to talk about his own roles in the network's stubborn, hapless defense of the flawed segment on President Bush's National Guard service.

Howard has also indicated to colleagues that he would subpoena specific CBS documents, including the e-mails of top executives.

Jay Goldberg, a civil litigator who has represented Donald Trump, said the idea of asking employees to resign "is really offered by the employer for protection for any breach of contract," as "an inducement to the employee to walk away with his tail between his legs and put him in a position so he cannot sue."

According to Mr. Goldberg, if a chief executive made public statements about employees that cannot be supported by facts—i.e., by the narrative of the Thornburgh report or, worse, other unreported material—it could open the company up to trouble.

"They were very foolish to go public with an attack on these people, because they lose their immunity to be sued for defamation," Mr. Goldberg said. "Whereas if they had put these very same things in court paper, they could not be sued."

There's a huge difference.

The protective media colleagues and trolls that were posting here in defense of CBS used the "CBS fired four employees" line to illustrate CBS supposedly coming down hard on the story when they obviously did not.

The employees are still there, after all. They did not resign, so yes, there's a difference in being fired and resigning (especially when the resignation doesn't come to pass).

Gmail has one GIGABYTE of storage space. And most folks ahve more than one e-mail account (thanks to free e-mail services like Yahoo!, Excite, Hotmail; plus a work e-mail addy).

Lots of e-mails can be forwarded that way.

Good cartoon--it captures the present situation very well.

I have read the New York Times piece and the others this morning regarding the "War at CBS News." A couple of observations:

1. The MSM is still trying to defend CBS, saying they only rushed the story on the air due to "zeal to beat the competition." We all know that is a lie---it was their hateful zeal to destroy President Bush in the weeks before the election that motivated them.

2. Dan Rather's tearful "Goodbye" puff shows are severely threatened by this latest war inside the Old Media and CBS. Rather wants to go out with what dignity he can muster and with some semblance of respect--this threatens all of that.

3. Rather is organizing a campaign to say he was ousted and targeted because of his "commitment to Civil Rights"--not his obvious and unprofessional bias over the years. If this CBS internal news war goes on further, it will obfuscate his carefully written script. Rather may retaliate against CBS if they do not settle this quickly. Expect high pressure from all sides. What the ousted producers want is a lot of cash for resigning and some "face saving" language by CBS. Expect them to get both.
