TASK FORCE BAGHDAD TROOPS RESCUE TWO KIDNAP VICTIMS
BAGHDAD, Iraq –Soldiers from 2nd Brigade Combat Team, 10th Mountain Division, stopped a vehicle they thought was suspicious at approximately 4:20 p.m. on Feb. 7.
When they searched the vehicle, inside the trunk, the Soldiers found two blindfolded and bound men. The men were two of four Egyptian kidnap victims, taken captive on Feb. 6.
When the vehicle first stopped, the three occupants fled the scene on foot. The Soldiers followed in pursuit, catching two. The two men caught are being held for further questioning.

OK, important point ... the two captured terrorists, caught red-handed with two of the four kidnapped Egyptians, probably know where the other two are being held. Chances are now that the remaining kidnappers will either attempt to trade for their compatriots or behead the other two in retaliation. Teddy Kennedy, what do we do? Heck, even Dershowitz knows the answer to that one.

The two men caught are being held for further questioning.This is an instance in which torture could be appropriate (if a qualified interrogator makes the call), because innocent lives are at directly stake by unlawful conduct (kidnapping).
No one "should" be tortured, but no one should be kidnapped either. And they certainly shouldn't have their heads cut off.
