Judge Rules There Will Be No Revote [WA, Rossi gov election suit, 'no authority to order revote']

WENATHCEE - A Chelan County judge has refused to order a revote in Washington's achingly close governor's race.

Superior Court Judge John Bridges ruled today that he doesn't have authority under state law to order a statewide, second election, as requested by the Republican Party.

The Republicans are contesting the election of Democrat Christine Gregoire, who was named governor only after winning a second recount of ballots over Republican Dino Rossi. Gregoire won by just 129 votes out of nearly three (m) million ballots cast.

Earlier today, Bridges dismissed all the counties and county auditors from the case.

That simplified the case from 81 parties to four. The remaining parties are the Republicans suing the secretary of state, and the Democrat and Libertarian parties who intervened.

However, Bridges did not dismiss the case, as requested by Democrats.

It's likely headed now for the state Supreme Court.

Republicans hope to go to a trial where they can argue they have uncovered enough problem votes to outweigh Gregoire's 129-vote margin of victory over Rossi.

Exactly Right! The bottom line is this is good for us. As far as that possibility that Brad Owen might be GOV for a day, I don't think anybody saw that coming. It does suck that it will take till NOV if things go are way, but I can live with that I guess.

Is it possible that an alternative remedy is to declare the governorship vacant? Just asking.

In a really strange way the judge created a "Solomon's choice" with his rulings today. If the contest is successful neither candidate gets the "baby". Rossi is "cleansed" of the arguement that he's just in it for his personal ambition -- if he's successful he won't be Governor in the short term. Rossi can only fight on principle now, because his opportunity will only come much later.

It's just that Gregoire won't be Governor either. The election will be voided and Brad Owen takes over near term. Perhaps that's a bit of salve to the exceedingly touchy Democrats -- maybe even a tempting morsel to some.

I guess that will be Sam Reed's legacy: No Governor!

Look for a retraction in tomorrow's paper, if they have any journalistic integrity at all. They got that part wrong; the judge would be asking for an impossibility if it was accurate.

That standard cannot be the law. If it were, then no matter how many illegal voters voted, no election could be overturned absent prrof of concerted fraud. I don't think that passes the smell test, particularly if the odds are high statistically, that the result would have been reversed, given where the illegal voters voted. We shall see. If it is the law, if is flawed. It creates incentives that should not be created.

"I fully expect to see many Washingtonian Democratic Party voters so completely sickened by the disgustingly transparent appearance of fraud by Dem officials and courts, that they will consider the Right path hereafter."

Do you really think that will happen? I know Dems that don't agree with the party but vote Dem anyway because that is what they have always done.

They're like Moslems/Moos - stupid is stupid, in perpetuity. It takes a certain level of idiocy to be either; curing that is not trivial.

"he doesn't have authority under state law to order a statewide vote"

Then why didn't we take this directly to the State Supreme Court in the first place ..??

But .. I guess the part about dismissing the case had to be handled in the lower court.

When you stop calling the jackass recount request "legal", you will be half way there. Socialists have no respect for the law, get a clue.

Ummm... the recount request WAS legal. We have a clue. You, unfortunately, seem to need an appointment with a ClueBat™...

This would be a really good time for heavy skepticism about any media reports coming out of Washington State regarding the election litigation procedings. This article from KOMO, as well as several other media reports we're seeing, does not accurately reflect today's rulings by Judge Bridges. The good news is the judge ruled against all the Dems motions to dismiss the lawsuit, it's going forward and the evidence will be heard. If the judge believes the Rossi campaign has met the burden of proof, the election will be nullified. I don't think anyone's really sure where we would go from there if that should happen. What the judge determined is that he doesn't have the authority to order a revote.

"Expect to see a flurry of legislation,"

this is already happening.....there are proposals for more gun control ( banning) and making homosexuals a protected class, and for making companines pay into a fund so their employees can now have mandated paid family leave time or some such nonsense....

thx to all Washingtonians who did not vote for Rossi, or who were just too lazy to really get out and vote....

this is what you get....

"Solomon's choice"

Quite so. Interesting observation.

We'll get to watch in coming days how the dems are perfectly happy to divide the baby.

Since the smartass scumocrats liked to take swipes at "Governor" Bush when he was in the oval office, I see no reason why Republicans shouldn't continue to refer to the fraud in the Governor's mansion as Attorney General Greogorie. That's the highest elective office she's ever held, and please note that "Governor" Bush managed to win EVERY single count in Florida... unlike the Fraud in Washington state.
