Ohio Supreme Court Justice Alice Robie Resnick was charged with operating a motor vehicle while under the influence and driving outside marked lines yesterday in Wood County.
The 2:02 p.m. arrest by the State Highway Patrol followed several cellphone calls from motorists reporting an erratic driver on southbound I-75, according to Lt. Rick Zwayer, a patrol spokesman.
Resnick, 65, of Toledo, was pulled over near Rt. 6 south of Bowling Green, where she failed field sobriety tests, Zwayer said.
Resnick was taken to the patrols Findlay post, where she refused to take a test of her bloodalcohol content, Zwayer said. That led to the charge of operating under the influence, a firstdegree misdemeanor. The marked-lanes violation is a minor misdemeanor.
Her drivers license was automatically suspended because of her refusal to be tested.
Court officials said there is no standard disciplinary action when a judge is charged with driving under the influence. Only felony charges trigger an automatic suspension from the bench.
Resnick was released by the patrol to the custody of a relative.
She received a summons to appear at 8:30 a.m. Wednesday in Bowling Green Municipal Court.
"She wouldnt be considered a flight risk," Zwayer said.
Her state-owned car, a 2001 Jeep Grand Cherokee, was impounded.
Resnick, a justice since 1989, is the seven-member courts only Democrat. She could not be reached for comment last night.
Chris Davey, a spokesman for the Supreme Court, declined to comment. The court was not in session yesterday, but is scheduled to return today.
Resnick is a former judge of the 6 th District Court of Appeals in Toledo and before that served on the Toledo Municipal Court. She and her husband live in Toledo.
Resnick was part of a 4-3 majority and the author of one of the edicts that ruled against the state in a series of school-funding decisions that declared Ohios current setup unconstitutional.
She also was part of a fourjustice majority that in the late 1990s declared limits on civil lawsuits unconstitutional.
A four-year court battle over $4.2 million in secret contributions to a 2000 campaign to defeat Resnick ended Friday with the disclosure by the Ohio Chamber of Commerce of more than 300 donors names.
Resnick won a third six-year term despite the "Lady Justice" ad that showed a justice peeking from under her blindfold to see bags of cash being dumped on her desk.
Resnick defeated Republican Terrence ODonnell, of Rocky River, 57 percent to 43 percent. ODonnell later was appointed to the Supreme Court by Gov. Bob Taft and was elected to complete an unexpired term Nov. 2.
Leaders of Citizens for a Strong Ohio, the chambers issue-advocacy group, argued it was not required to follow election law for candidates, political parties or political-action committees because it did not directly promote the election or defeat of a particular candidate.
The Ohio Elections Commission and several courts disagreed, ordering the disclosure of contributors names under the threat of $25,000-a-day fines.

No, this will be twisted into a "win-win" situation by the "judge's" sympathizers (trial lawyers, unions, other left organizations). It will go "what a wonderful thing that she can point out the damage done by DUI, this proves no one is above the law, she has "learned" what its like to undergo the punishment system. She will be called the "best judge on the Court" because she's seen both sides of the criminal justice system, she can be more compassionate. Believe me, her drunkeness and out of control behavior will be spun this way, not the truth that she could have killed someone and is probably so arrogant due to Her Loftiness that she thought she'd never be caught.

So, this judge was sauced on a Monday afternoon? When does she work? Did she go out for a liquid lunch, or was she drunk all morning too? Has she been drunk on the job? Don't worry, we won't be hearing too much more about this as she is a Democrat.
Well, ain't that grand? Stinking Dim-lib gets a tax-payer funded vehicle to facilitate her drunken carousing.

She will scream long and loud that it's a right-wing conspiracy, that she was targeted by her opposition.
The disappointing fact is that there are those out there that will agree with her.

Um... lawyers are sued all the time. Like doctors, lawyers are required to carry malpractice insurance.

The Ohio chamber sponsored a television spot depicting Lady Justice as peeking from under her blindfold to watch contributors pour money into her scales of justice -- a suggestion that Resnick was paid off for Supreme Court rulings.
Resnick, a Democrat, was a target because she was in the majority when the court declared that tort reform was unconstitutional and again in the majority when the court declared school funding to be unconstitutional, requiring a significant infusion of tax state dollars. ...
The fact is "Overfed Ted" had an expired license - which means he had NO LICENSE - at the time of the murder. Because of the nature of the crime, I believe that would have raised the charges to a felony. In any event, a weekend telephone call was made to the Registry of Motor Vehicles Commissioner [the accident happened on a weekend], and a Registry employee actually went in on Sunday to "correct the error" - so that by Monday morning, "Swimmer Ted" actually had a valid license.
She needs to get drunk, because she is the lone Rat on the Court.

This was done in a state-owned vehicle. What is it with Democrats from Lucas County and DUI's in taxpayer-owned cars?????
The former Treasurer in Lucas County was caught for a DUI in his county-owned car. He was forced to not run for re-election.
Resnick has some explaining to do. She is up for election in 2006.
The liberal media in this state (Columbus, Northeast Ohio, Dayton, Toledo) bailed her out in 2000 because of all the "negative campaigning." The people fell for it.
Notice which newspapers are going ga-ga over Coleman this morning. It is the same ones. I don't know how these same papers can defend her actions. The papers to watch out for are the Dispatch and the Toledo Blade. The Blade went after the former Lucas County Treasurer after his DUI in a county car. The Dispatch has been on a crusade about these taxpayer-owned cars in recent years too.
One of these days I'm going to start a business that depends on the stupidity of Democrats. Watch out, Microsoft!
Unlike doctors, lawyers aren't put out of business by malpractice insurance costs alone.
Well, yes, they are. Malpractice insurance for securities lawyers, for instance, is now fantastically expensive, thanks to shareholder class action suits.
Yeah but lawyers can add that into their fees. Doctors can't; their fees are fixed by the government and by HMOs.
