ACLJ Prepares for Appeal as Federal Court Upholds Inaugural Prayer

(Washington, DC) – The American Center for Law and Justice, specializing in constitutional law, said today it is pleased a federal district court upheld prayer at the Presidential inauguration and rejected a request from Michael Newdow for a preliminary injunction that would have barred prayer from the January 20th event. Newdow is expected to file an emergency appeal with a federal appeals court and the ACLJ is preparing legal briefs to file at the appellate level....

LOL no, fed govt actually finds the ACLU! And they need to pull that funding! Newdow needs to get a life, other than worrying about what reference to God might be uttered within his earshot. If that is the worst that ever happens to him, he should thank.........his lucky stars or whatever!!

As a layman, here is what was described to me:

Under the rules of federal procedure rule 11 provides for sanctions for filing a frivolous claim. The unique aspect of rule 11 sanctions is that they attach not only to the client but to the attorney as well and they are joint and several. IOW the attorney can be forced to pay the full sanction regardless of only being partly responsible. Rule 11 sanctions can also get the attorney in trouble with their local bar over the various "candor to the tribunal" rules in ethics. This sanction is above and beyond taxing the court costs upon Newdow or making him pay the attorney fees. I think the public would very much welcome slamming newdow for the court costs of this lunacy. Of course it requires the Justice department to file a motion(s) for both.
