Article 1, Section 33 of the Washington State Constitution:

SECTION 33 RECALL OF ELECTIVE OFFICERS.

Every elective public officer of the state of Washington expect [except] judges of courts of record is subject to recall and discharge by the legal voters of the state, or of the political subdivision of the state, from which he was elected whenever a petition demanding his recall, reciting that such officer has committed some act or acts of malfeasance or misfeasance while in office, or who has violated his oath of office, stating the matters complained of, signed by the percentages of the qualified electors thereof, hereinafter provided, the percentage required to be computed from the total number of votes cast for all candidates for his said office to which he was elected at the preceding election, is filed with the officer with whom a petition for nomination, or certificate for nomination, to such office must be filed under the laws of this state, and the same officer shall call a special election as provided by the general election laws of this state, and the result determined as therein provided. [AMENDMENT 8, 1911 p 504 Section 1. Approved November, 1912.]

I added the emphasis. There's case law (State Supreme Court rulings) up the ying yang on this and they all come to the same conclusion: This means exactly what the words say.

It isn't perhaps an essential element, but there are very few Cedars in Eastern King county.

MmmmHmmmm, and how many kings are there in King County? Back on topic: this is a farce.

At this point I think all the doctors and businesspeople should move out of the state. It's not safe for them anymore in Washington.

And let it be taken over by the red diaper doper baby, tree hugging, Bush bashing, troop demoralizing liberals? Don't think so. Running away aint gonna solve anything.

A caller to the John Calson show on KVI described his experience as an observer for the manual recount. He told about how the King County employee counting the votes would sometimes slip a Rossi vote in the GreGore pile. This will happen in the blink of an eye, because the employees were already racing through the process. When the piles get counted, GreGore picks up a few extra votes from the Rossi votes that got slipped into the stack. When the observer wants to check the stack, the employee gets defensive. When upon discovering there are Rossi ballots in the GreGore stack, the employee gives a "whoops I guess I missed a few." and continues on as if nothing ever happened. Also, not all of the observers are checking the stacks. And, the counting of the stacks is not always consistent. One person will count the stacks and get a higher number. If it is a GreGore stack, the higher number gets recorded as the final count. King County was working to capture for GreGore the Governorship what the rest of the state will not.

Well, without the doctors the red diaper doper tree huggers are liable to die off more quickly. There is that.

I gotta tell ya, I get any opportunity for properly gainful employment in the mountain west...well, it'd be tough to say no.

I have it on good authority (from someone in the state GOP) that King County double-counted some precincts in the first recount. Those extra votes should be subtracted during the reconciliation process.

Statistically, once would expect that to be bad news for Gregoire.

Could be, but to paraphrase and embellish Nakatu X, anecdotal evidence and $5 will get you a cup of coffee at Starbucks (maybe). Besides, the Rats are telling (making up) similar stories about the Rossi counties.

The Republican Party should announce that due to the irregularities of this election, either a new election be granted (either this year or next November) or a recall effort will begin.

Under state law, the court can throw out the results of an election if there has been such gross incompetance or fraud that the result cannot be trusted. But that's as far as the court's authority goes.

From that point on, the rest is up to the legislature. The legislature would have to set the date of a new election and set up the ground rules. For example, should the revote be a complete rerun with all candidates or a runoff with only the top two? Should the new election be coupled with vote reform, such as tightening up the rules for absentee ballots, abolishing provisional ballots and requiring picture ID at the polling place?

There would be a lot to do. Brad Owen would be acting governor until this could be all sorted out.

With all due respect to Carlson (& to your reportage) if this had really happened, don't you think it would be spread all over the news right about now?

If it occurred, and was documented, the Washington State GOP would be in a courtroom as we speak, obtaining an injunction against Logan and his machine.

My brother served as a volunteer observer and there are few that are more eagle-eyed than him! He saw plenty of improprieties, but nothing illegal.

"My child may be in public school, but early dismissal tomorrow is for Christmas vacation and at the school board meeting I attended tonight. The Pledge was also said and then a prayer and an additional prayer and moment of silence for a 2nd grader who died of a heart attack in class last week. And everyone wished each other a Merry Christmas at the end."

This school is archaic. Where's Newdow? I'm sure some little atheist was offended by YOUR Pledge, YOUR Prayer, and YOUR tidings of Christmas joy. You must live in one of those Red(neck) States with your Gods, Guns, and Gays. :)

Well, what a shocker.

The communist 'rat fraud machine of King County and the communist 'rat fraud machine of the elections board after eight tries found just enough votes in 'rat fraud King county to throw an election to communist 'rat fraud attorney general Gregiore.

This is stunning.

Who would have guessed?

"reciting that such officer has committed some act or acts of malfeasance or misfeasance while in office, or who has violated his oath of office, "

Ah, but she _is_ in office...she's the Attorney General. Does that count? I guess the courts will decide, again. Sigh.

"This one isn't over. I'd expect to see several people on both sides busted for vote fraud before it's done, and maybe even a re-vote."

The worst case scenario would be a re-vote if there's rampant fraud. But more than likely we'll come out of this with even more recount procedures.
