What if she had bought rope instead of a gun? Would they want to hold WalMart liable for that?

She would of had to of lied when purchasing the firearm, so I don't see any culpability on Walmart's part. It is not like the pharmacist was filling in at the gun counter and you could argue that Walmart failed to act in a reasonable manor.

Exactly! Deep pockets are being preyed on for the most outrageous things these days! Sounds like WalMart did everything according to the law so I say any judge or court that would even take this case is another example of why we need tort reform..........NOW! BTW, my heart goes out to these parents but if this young woman was determined to kill herself, she'd have found a way.

People can say what they want about Walmart, but, having been in the insurance claims business for twenty years, the fact that they fight every claim is one of the few reasons I shop there from time to time. I do recall they paid a couple of hundred thousand bucks recently in a case in North Carolina in which they were sued for selling ammunition that later killed someone.

It sounds to me like the parents are suing to absolve themselves of any guilt or responsibility in this tragedy. If they can convince a judge or jury that it's WalMart's fault, then they're off the hook.

"fine the mother for a frivolous lawsuit."

That should be the first step in tort reform.

Phil Hendrie had a spot on his program where a former slave owner was suing the government for financial losses from the lost labor of those emancipated. The take here might be Wal-mart suing the family for bad publicity.

It's the entire 'it's somebody else's fault' mentality that is out of control. And what is especially sinister about it is that it has become a for-profit industry.

No good can come from any of this.

I feel sorry for her parents, but if this girl was set on killing herself, she would have found another way even if WalMart had refused to sell her the gun. She'd still be dead.

"I'm sad for her family,..."

I'm not. My sympathy went away when they filed this frivilous lawsuit. They should be driven to the nearest Wal-Mart, taken out back and pistol-whipped by the gun department employees for trying to make a buck off of their "tragedy". Tort reform NOW!

If she wants to sue, she should sue the state of texas for not submitting the mental records to the system... of course states have deep pockets and all the time in the world... Wal Mart's far more likely to pay...so the attorney's decided to go after them.

I use the "more better" phrase because I am grammatically challanged. It is surprising how many people miss it.

My husband and I bought a little rifle (maybe a shotgun, I forget). Anyway, he wasn't allowed to buy the ammo with the gun. I bought it on a separate purchase. We asked the guy why that was. He said it was to protect me in case my husband was a nutter. If that is the policy at that Walmart, I would think it is the policy everywhere. You can buy a gun and not ammo or vice versa, but you can't buy both at the same time.

It sounds like the parents are to blame for not reading the signs on their own daughter and locking her up. I can't stand our society of blaming everyone except the person who did the deed.
