I am not sure about this one. Do you have a feel for this?

He should, but I predict he won't.

I don't think anyone who was convicted of a crime without the kind of physical evidence in this case should get the death penalty. Putting this guy away for life is good enough for me.

I believe he will not. However, I believe it would be to Peterson's advantage to get the death penalty as it will increase his chances on appeal and he would probably never be executed anyway (I think there are more than 400 death row inmates in California). An appellate court is much less likely to find "harmless error" where the DP is involved.
To: BellStar
He should get life.
That way the state will save millions on his appeals.

Yeah, that's the ticket. Lock him in a room with the Indiana Pacers ... or with the Detroit Pistons' fans.
To: BellStar
Nope. No blood, no smoking gun, method/location of murder unknown.
To: BellStar
I have no feel. Obviously, few people have ever been convicted on so little evidence--never by an impartial jury--and, even then, they had to dismiss dissenters and put two headhunters in as substitutes.

Nope. No blood, no smoking gun, method/location of murder unknown. Now that raises an interesting point. If the evidence of guilt isn't good enough to sentence a defendant to death, is it acceptable to sentence that same defendant to life in prison w/o parole based on that very same evidence?
To: BellStar
In view of the speed with which the jury convicted Peterson (after finally getting the jury settled) it looks to me like Scotty Boy has a date with the gurney. It is pretty clear that there are not a lot of Scott Peterson fans in that jury room.

I'm thinking that if the concerted effort Peterson made to pull this murder off is highlighted in the penalty phase, the plotting, planning, concealment and absolute devious nature of his crimes, he will. The death penalty is made so society doesn't have to waste the tax $$$'s to support a monster like this @ $200,000 per year for, conceivably, the next 50 years.

He should, he'll get the sentence, but whether it's actually imposed out there is anyone's guess.

Scott Peterson will live longer on death row than he will in the general prison population. If he is exposed to the general prison population, he will be killed in short order.
That said, I think if this jury is given the penalty issue, they will give him the death penalty.
