Now that raises an interesting point. If the evidence of guilt isn't good enough to sentence a defendant to death, is it acceptable to sentence that same defendant to life in prison w/o parole based on that very same evidence?
Guilt was determined on circumstances and beyond a reasonable doubt. Sentencing is s different ball game. Death I should think would have to present more "evidence" than beyond a reasonable doubt.
