Interesting concept.

Terrorism could be tried as a war crime or a crime against humanity.

My answer is no

One mans terrorist could be another resistance.

If America or my country was invaded and we resisted we would not want to be classed as war criminals.

Yeah. My hearts bleeding, too. Funny how nobody notices how America bends over backwards in applying THE RULE OF LAW in all these cases. Lots of other places (Cuba, China, Iran, etc...)you'd just be taken out an shot! When are we going to learn these people are totally outside civilized behaviour, and only use our institutions agaist us? And another thing, terrorism might not be a war crime, but it's a crime against humanity. Let's see if the UN or the Geneva Conventions get updated to include it. Right after Tareeezah sobers up (sarc :-)

We are talking about prisoners of war. These prisoners should be held until Al Qaeda formally surrenders.

Sounds off the wall.

They are being tried as unlawful combatants under the law of war. Whether they fit that definition should be clear from treaties the congress has ratified. Nothing 'retroactive' about it.

Well, far as I recall, there's something called perfidy in the 1977 addition to the Geneva Conventions

http://www.globalissuesgroup.com/geneva/protocol1.html#37 Article 37 1(a) and 1(c) seem particularly pertinent to Iraq and Afghanistan. I think there's also something about the movement of forces with the intent to engage the enemy under a civilian guise - can't recall where.

Clearly the Geneva Conventions are inadequate when it comes to all the methods favoured by terrorist forces. It just disappoints me that rather than recognising the urgent need to fill this gap in international law the rest of the world would rather condemn the US for its attempt to bring justice.

Of all of the rights granted by God to people all across the globe, the right to vote, the right to own property, the right to enjoy free press, the right to free speech, there is one over riding and fundemental right recognised and enforced by every government on the planet. The right to life. The right to continue to live.

When terrorists plot, finance, rehearse and exacute the slaughter of thousands and thousands of my people, they breach this fundemental civil right to continue to live.

Any sensable and balanced debate on civil rights must include this metric as a component of the debate.
